US Court Blocks Overtime Expansion Pay Rule for 4 Million

A federal court on November 22 blocked the start of a rule that would have made an estimated 4 million more American workers, 392,000 in California, eligible for overtime pay heading into the holiday season, dealing a major blow to the Obama administration's effort to beef up labor laws it said weren't keeping pace with the times.

The U.S. District Court in the Eastern District of Texas granted the nationwide preliminary injunction, saying the Department of Labor's rule exceeds the authority the agency was delegated by Congress. Overtime changes set to take effect Dec. 1 are now unlikely be in play before vast power shifts to a Donald Trump administration, which has spoken out against Obama-backed government regulation and generally aligns with the business groups that stridently opposed the overtime rule.

What does this mean to you?
  • As a result of the ruling, employers currently do not need to comply by the original December 1 effective date.
  • The injunction is temporary pending further review by the court.
  • We have no way of knowing if or when the status of the regulations will change.

Next Monday, the legislature is set to reconvene to begin work on framing the legislative and budgetary priorities for the upcoming 2017-18 session.  

It is important that we as a field, are united and strong in our "asks".  To that end, below are two considerations that we hope to see in all advocacy platforms that are put forth:
  • All provider types and programs must be lifted together; not one part of the child care and early learning system at the expense of another.
  • The mixed delivery system of public and private child care and early learning programs are jointly funded to ensure that absolutely all slots are filled and not one dollar is sent back to Sacramento at the end of the fiscal year.
 
What's Happening

California 
The 2017-18 Budget: California's Fiscal Outlook 

On November 16, 2016, The Legislative Analyst's  Office released it's annual Fiscal Outlook report. The report describes the office's assessment of the state's economy and budget over the 2016- 17 through 2020-21 period.

The report discusses child care and some topics of interest include:
  • Overview of State Subsidized Child Care
  • Assumptions Underlying Child Care Forecast
  • Child Care Cost Projected to Increase Notably in 2017-18
  • Out- Year Child Care Costs
  • California in Midst of Responding to New Federal Requirements

NOTE:  As all are aware, on January 1, 2017 updated Regional Market Rates updated to the 75th percentile of the 2014 survey are set to go into effect for most providers.  However, in every county there were many provider rates that were covered under an 18-month "hold harmless" provision.  What this provision means, is that no provider will go down in rates.  The hold harmless provision is in effect for 18 months.  

At the end of the 18-month hold harmless time frame, in every county there will be provider rates that go down.  During the release of the LAO fiscal outlook, CAPPA asked the question, "What is the amount of the hold harmless language?"  Response.  "$32 million."  

So what does that mean?  It means that effective July 1, 2018, $32 million in provider rates from those providers that fall under the hold harmless provision, will have their rates dropped.  

The CAPPA board has made this a top priority to eliminate this hold harmless language in perpetuity.  If you want to know more about this issue, contact CAPPA.

Federal

When Temporary Assistance for Needy Families (TANF) replaced the existing welfare program, Aid to Families with Dependent Children (AFDC), in 1996, it established work requirements and time limits on cash assistance, with the stated aim of helping families achieve self-sufficiency. Recognizing that mothers now required to work would need help affording child care, Congress provided a significant boost in funding for the Child Care and Development Block Grant (CCDBG). TANF had some initial success in moving mothers to work during the strong economy of the late 1990s. However, with its strict work requirements and flat funding, TANF failed to respond to the increased needs of families struggling during the economic downturn, and has left many families without assistance during the slow recovery. Compounding this challenge, many families no longer able to receive TANF cash assistance have not been able to turn to child care assistance to help them get back to work because child care funding has also been stagnant. A number of states' policy decisions have made it even more difficult for families to access TANF or child care assistance. As a result, many families are left without either a primary or back-up safety net as they struggle to meet their basic needs and ensure the well-being of their children.
  • While the number of families in poverty increased, TANF served fewer and fewer families in need. The number of families with children living in poverty, after declining from 6.4 million in 1996 to 5.1 million in 2000, rose to 7.1 million in 2014. Yet the TANF average monthly caseload fell by about two-thirds during that time-from 4.4 million families in 1996 to 1.6 million families in 2014. In 2014, TANF served only 23 of every 100 families with children in poverty.
  • Under federal time limits, a family can receive TANF assistance for no more than five years in a lifetime, and states are allowed to set even shorter time limits. A number of states have taken advantage of this option to create tighter time limits on cash assistance, which can allow them to spend less money and tout a lower number of families on welfare. The shorter a family's time limit is, the more pressure there is for parents to find work quickly, which could mean accepting a job with low wages and irregular hours.
    • Many states set lifetime limits on TANF cash assistance that are shorter than the federal lifetime limit. These states include Arizona, Arkansas, California, Connecticut, Delaware, Florida, Georgia, Idaho, Kansas, Michigan, Missouri, Ohio, Rhode Island, and Wisconsin. Arizona, which limited families to no more than one year of cash assistance in their lifetime as of July 2016, has the strictest lifetime limit in the country.
    • Several other states, while allowing families to receive assistance for up to the federal lifetime limit of five years, set limits on the number of consecutive months for which they can receive cash assistance. Louisiana, Massachusetts, Nevada, North Carolina, and South Carolina allow families to receive cash assistance for only 24 consecutive months. Texas limits families to either 12, 24, or 36 consecutive months of assistance depending on the individual's work history and educational attainment; when a family reaches its time limit, it cannot receive assistance again for another five years.

California Commission on Teacher Credentialing: Child Development Permit Advisory Council- Public Input Needed

Pursuant to Senate Bill 858 (Chap. 32, Stats. 2014) the Commission has convened the Child Development Permit Advisory Panel (CDP AP) to review and update, if appropriate, its requirements for issuance and renewal of permits authorizing service in the care, development, instruction, and supervision of children in care and development programs and the programs that serve them. 

The Commission has released three ECE focused surveys for stakeholder feedback. These surveys reflect the work of the Commission's Child Development Advisory Panel. Survey I  addresses the advisory panel's recommendations regarding the Commission's existing Child Development Permit; Survey II addresses new Performance Expectations for ECE teachers; and Survey III addresses new draft preparation program standards for the ECE workforce. Completion of these surveys allow for public input and are critical to the development of relevant policies. We encourage stakeholders to participate in the survey. 

 
Minimum Wage Increase Task Force: a sub-committee formed by the State Advisory Council on Early Learning     and Care

In October, the State Advisory Council on Early Learning and Care (SAC) held an initial meeting to investigate and make recommendations for implementing minimum wage increases in child care and early education. The SAC unanimously supported a motion to have a Minimum Wage Task Force bring a report and recommendations to the January 2017 SAC meeting.
Public input will help the Minimum Wage Task Force develop information and ideas to submit to the SAC, so that it can advise the Administration on how California should plan to meet minimum wage increases in early learning and care. We encourage participation by child care professionals, parents, policy experts, the business community, and other stakeholders. The public meeting is a unique opportunity to contribute to this process.

The Early Education and Support Division Process for Updating Title 5 Regulations Plan of Action

The California Code of Regulations Title 5 (5  CCR) , Chapters 19 and 19 . will be current and aligned with California laws enacted over the past several years as well as the federa Child Care and Development Fund (CCDF) Program Final Rule published September 30,2016 .

This will be achieved by amending , adding , or deleting appropriate child care and development sections of 5 CCR following the Office of Administrative Law (OAL)  r ulemaking process , which includes public comment periods

The 5 CCR sections which will be updated will be determined  based on the need to  comply  w ith California laws and federal laws and regulations Early education contractors,stakeholders ,and appropriate state agencies will be invited to submit suggestions of 5 CCR sections needing to be updated.

EESD/CDE, DSS & CCLD Updates

November 23, 2016:
Fiscal Year 2016-17 RATE INCREASE APPLICATION.  California Education Code (EC)Section 8265(d) allows a rate increase for contractors on a case-by-case basis in order to maintain service levels for contracts currently at a rate less than the Standard Reimbursement Rate (SRR). Increases approved through this application will be retroactive to July 1, 2016.  Click here to download application.

November 21, 2016:
The CDE/EESD has announced plans and a process to promulgate regulations that will update the California Code of Regulations, Title 5 (5 CCR), Chapters 19 and 19.5. Many of the provisions of these regulations need to become current and aligned with California laws recently enacted, as well as the federal Child Care and Development Fund (CCDF) Program Final Rule, published September 30, 2016.

The CDE/EESD wishes to inform you that Management Bulletin (MB) 13-08, Personnel Roster Data Spreadsheet (PRDS), which requires contractors to submit their PRDS by October 31 of each year, has been rescinded. Contractors are no longer required to submit the PRDS to the CDE/EESD.
