We have seen a disturbing and dangerous trend of government agencies creating their own rules and acting as judge and jury.



The podcast discussion describes how PLF intends to build upon the existing precedents that strengthen judicial review of administrative agency decisions, and specifically to expand access to federal courts for all Americans confronting arbitrary and abusive agency actions.

Brian Hodges
Principal Attorney
Brian Hodges, a Principal Attorney in PLF's regional office in Bellevue, Washington, wrote an op-ed for The Daily Caller on expanding the supply of affordable housing. "The lack of affordable middle and low-income housing in major urban areas is a real crisis facing our nation," writes Hodges. "Skyrocketing costs are leaving low-income families with few options and forcing middle-class families to either give up on the dream of home ownership or relocate away from urban centers. Looking for an easy solution to this complicated problem, hundreds of cities and counties have adopted so-called "inclusionary zoning" ordinances, demanding that developers build and sell a certain percentage of the homes they develop at below-market rates." James Burling, PLF's Director of Litigation, also authored a PLF Liberty Blog post on the topic of new affordable housing rules in Los Angeles.

                                                           

PLF Senior Staff Attorney Tony Francois joins Andy to discuss how the government of San Joaquin County is trying to jail a single mother...for a year...for selling a plate of Mexican food to an undercover police officer. Also, Tony covers a recent Q & A published by Reuters which gives an overview of PLF's suit against the EPA and Army Corps of Engineers over how the federal government regulates "navigable waters" under the Clean Water Act.

Johanna Talcott

Johanna Talcott, an attorney and fellow in PLF's College of Public Interest Law, authored a blog on how sea otter recovery efforts are negatively affecting the fishing industry. "Sea otter recovery is a worthy cause, but it doesn't need to come at the expense of healthy, sustainable fisheries and hard-working fishermen," writes Talcott. "Congress recognized 40 years ago that a balance could be struck between these two competing interests, and it codified that balance into law. The Service is bound by Congress' clear statutory direction. Now, thanks to the tenacity of the fishermen in this litigation -- and PLF's donors -- the court has an opportunity to reaffirm this fundamental principle."
