Federal Court Holds Creek Reservation Never Dissolved
A three-judge panel of the Tenth Circuit has determined the original boundaries of the Creek Reservation were not disestablished or diminished by Congress, regardless of the allotment process in the early 1900's.  Consequently, as the murder offense at issue in the case was committed in Indian Country, the Creek citizen should have been tried in federal court - not in Oklahoma state court.  This is an important decision due to potential implications including the expansion of our common understanding of Indian Country in Oklahoma.  There is a widespread immediate impact because the Creek Reservation encompasses in whole or in part eleven (11) Oklahoma counties including parts of Tulsa, Broken Arrow and Muskogee.  The Court has granted the State additional time to file a petition for rehearing before the entire Tenth Circuit.  Read Article
