Employers Need to Watch Marijuana Legalization

With marijuana on the ballot in nine states, next Tuesday's election could have a major impact on the workplace. Voters in five states - Arizona, California, Maine, Massachusetts and Nevada - will decide whether to legalize recreational marijuana for adults. Medical marijuana is on the ballot in Arkansas, Florida, Montana, and North Dakota.

State legalization of marijuana is of real concern to employers. The regular use of marijuana on or near the workplace can lead to a loss of productivity and an increase of workplace accidents. While employers strive for a productive and safe workplace, they must also ensure that they do not violate the rights of their employees in the process. Here are a number of steps that employers can take to ensure that they are operating within the guidelines of the applicable law:
  • Know your law. Be familiar with your state's marijuana statutes as well as any other statutes that may be applicable to your employees. Does your state allow "for cause" drug testing of an employee if you reasonably suspect impairment?
  • Review your policies and enforce them with consistency. It is important for employers to act with consistency in their policy enforcement and to carefully document instances of any behavior that is outside the norm for an employee, in addition to verification of potential substance use that could simply confirm problematic conduct.
  • Make sure your employees know your policies. Draft clear policies about substance use, explaining the definition of "zero tolerance" and identifying those positions which are classified as "safety sensitive." Include policies specifically relating to marijuana, including off-duty use of marijuana, so that all employees are clear as to how to stay in compliance.

Judy Gootkind, VP Finance and Administration with Creative Services, Inc. was selected as the October 2016 National Association of Professional Background Screeners (NAPBS) Volunteer of the Month. Judy is currently serving as co-chair of the Advocacy Committee, immediate past chair of the BSCC, as well as a member of the Finance Committee, Governance Advisory Group and Government Relations Committee. 

Volunteers play a vital role within NAPBS, working alongside staff members and other volunteers to jointly achieve the association's goals. Through the NAPBS Volunteer Recognition Program, the contributions of the volunteer workforce are recognized. Thank you for all you do, Judy!
