Swimming with the Sharks -  Architects and the Arbitration Process

Description:
For many years the AIA, and the rest of the construction industry, has included arbitration as the preferred means to resolve legal disputes arising in the construction process. At one time, arbitration was a fairly informal process (parties often participated without attorneys), but over the years it has increased in complexity and expense. The Architect's role in the arbitration process has also become more complex, creating potential conflicts and liability. This seminar is intended to review what the Architect can expect in the arbitration process, and explore some potential traps and how to avoid them or mitigate their effects.

Learning Objectives:
  • Discuss the role that arbitration plays in the construction process.
  • Familiarize attendees with arbitration procedure under standard AIA contract clauses and American Arbitration Association rules.
  • Understand the issues unique to Architects while participating in arbitration.
  • Explain how an Architect may become an AAA arbitrator, and what to expect.

About the Presenter:  Margie Lynn Loeser, Esq. is an attorney in private practice.

Bachelor of Architecture: University of Kentucky
Law Degree: University of Louisville

Ms Loeser has served as an arbitrator in numerous construction disputes, and is a construction, commercial, and large/complex case panel member of the American Arbitration Association.

Practice Concentration: Civil litigation and construction law.

Construction Law Experience: Complex construction, environmental, and commercial litigation in both federal and state courts, and has served as counsel for the City of Louisville. Prior to beginning the practice of law, Ms Loeser was an architectural project manager for several private architecture firms and a construction contract administrator for the City of Louisville. She served as a member of the American Bar Association's Forum Committee on the Construction Industry Division Steering Committee and the Commonwealth of Kentucky Architect Selection Committee. She has also served as a resource member of the American Institute of Architects Documents Committee.

Description:   In this course, we explore the architectural uses for perforated metals, wedge wire, and profile bar. The audience will gain insight into how this material is manufactured, specified, and used in various applications. We will also explore its optimal uses as cladding, sunshades, ventilation grills, grating, entrance flooring, as well as other decorative elements.

AIA Kentucky is offering scholarships to up to eight (8) emerging professionals (Architect Members licensed less than 10 years or Associate Members) to attend the AIA Leadership Institute in Indianapolis on Friday, November 18. 

The scholarship will cover the registration fee; those selected will be responsible for travel and/or overnight expenses associated with attendance.
 

Complete the online application and submit no later than Friday, October 7.  Notification of acceptance will be made by October 14.

Architects Needed to Serve on the "Comprehensive Plan 2040" Advisory Council, in Six  Working Groups
Develop Louisville has asked for AIA-CKC's input and participation in the upcoming development of the 2040 Comprehensive Plan.  This new document will build upon the framework of the Cornerstone 2020 comprehensive plan and include new sections not included in that version adopted nearly 20 years ago.  While the 2040 Comprehensive Plan will be largely written in-house by Planning & Design staff, they are soliciting the input of experts like us to help influence the drafting of this document and guide their decisions.  We have already identified some volunteers as points of contact for each work group, but are still looking for addition AIA members to volunteer in each of the following work groups, particularly the ones in bold below:

Applications accepted for Leadership Louisville Center's Encore class of 2017

LOUISVILLE, Ky. (Sept. 8, 2016) - After two successful classes to date, applications are open for the third class of Leadership Louisville Center's Encore Louisville program.

Designed to give community trustees an encore, this program connects retired or retiring leaders in an advisory capacity with local nonprofits organizations in need of their experience, wisdom, and strategic vision.

"Encore classes have already contributed expertise to 35 nonprofit organizations valued at over $120,000," according to Dan Rivers, Managing Partner of Northwestern Mutual and a Leadership Louisville Center board member.

Northwestern Mutual is the presenting sponsor for the innovative program, which is believed to be the first of its kind among leadership programs in the United States.
Applications for the Encore Louisville Class of 2017 will be accepted through Oct. 17 at https://www.leadershiplouisville.org/ Individuals interested in staying engaged in civic leadership and with their professional peers despite career transitions are encouraged to apply. The upcoming program year begins in Dec. 2016 and ends in Nov. 2017.
