Legislative Update
Greetings from the Legislative Chair!
There are several items of attention regarding legislation that could affect massage therapists in our state, including you. Our lobbyist, Janet Mabry, and your Board of Directors have been keeping a close watch on new happenings in Tallahassee. Below I've listed several key items:
  • We received a summary on the review of Personal Injury Legislation which includes the reforms of legislation passed in 2012. The report was 416 pages long and was written largely in opaque industry jargon.  However the bottom line is that the analysis show that the cost saving accomplished by the changes to the law (the taking away massage under pip coverage amongst others) had no effect on the rates being charged consumers, only (and slightly on the profits of the insurers).The bottom line is that the effect of repealing PIP and replacing with mandatory bodily injury/ and/or medical payments coverage would not have much of an impact on rates.  Replacing the current $10,000 PIP protection with mandatory BI coverage in the amount of $25,000 per person/$50,000 per incident and $5,000 in first party medical payments coverage (which would cover the deductibles of the 85% of Floridians who have health insurance that would pay their hospital bills) would only result in a statewide average premium increase of $5.  The reason this may be important as it might mean that we could get more payments under BI through prescription massage if they go to this system.
  • There are a few court cases regarding Worker's Compensation Law that will be reviewed.
  • If Amendment 2 Medicinal Marijuana passes in the November election, then in the next legislative session, legislators will begin to craft new statutory language to implement the new constitutional amendment.  As a profession that deals with pain we plan to be attentive to the language.
  • There have been preliminary draft changes to F.S. Chapter 480, our licensing chapter, presented to the Board of Massage by FSMTA.  We are studying the draft and have sent it to National AMTA for their review and input.
  • We encourage you to vote in the November election! There have been several legislators that have been extremely supportive of massage therapy, primarily Representative Ross Spano from District 59, in the Riverview area, who is running for the House of Representatives as well as Senator Anitere Flores in district 37, Miami/Dade County. They have been helpful in the very complicated subject of human trafficking. We appreciate their support for massage therapy and the drive to stop human trafficking in its tracks.
  • There are a number of bills from the 2016 session that go into effect on October 1.  One of these is HB 545 Relating to Human Trafficking this bill had several issues relating to massage therapist that AMTA was very involved in getting included in the legislation.  The legislation reclassifies and offense of s. 796.07(2)(a), F.S., if the place, structure, building, or conveyance that is owned, establishment, maintained, or operated for prostitution is a massage establishment that is or should be licensed under s. 480.043 F.S., and adds such reclassified offense to the list of offenses that disqualify applicants from a massage therapist or massage establishment license.

Education

Dear Members,
We enjoyed a fabulous education event at the Upledger Institute in Palm Beach Gardens, FL. They have such wonderful instructors and Mariann Sisco was outstanding. We had lots of fun and learned CranioSacral techniques for Concussion. The class was well attended with a variety of skill levels represented by the attendees from brand new to CST to those trained up through SER. Teaching assistants Maria Mannino and Jeff Overstreet were quietly supportive and ever present sharing insight and guidance along with Mariann throughout the course.
JR Olson on behalf of Upledger Institute extended generous specials for all attendees customized for their previous level of training. Thank you all from Upledger Institute for your generosity to AMTA-FL and the massage profession. The Core-Pak program makes the financial investment and scheduling challenges easy to manage to continue through higher levels of training in this powerful and subtle work.
A special treat, this class was recorded for future teaching by Upledger Institute. Brianna seamlessly blended with the class to film this content as a resource. Our class is saved for posterity's sake! The focus on Concussion and Post-Concussion Syndrome has potential for helping so many groups and individuals from athletes, to soldiers and beyond. Upledger Institute has completed 2 research studies demonstrating the positive effects of this work. This sort of data helps the medical community and consumers realize the value that trained clinicians have recognized a long time.
