TSBEMFT Lawsuit Update: Good News!

On September 2, 2016, the Texas Supreme Court  reversed an earlier decision not to grant a hearing on the lawsuit filed by the Texas Medical Association (TMA) that challenged the authority of LMFTs to perform diagnostic assessments and base their treatment on a diagnosis.

The Supreme Court will hear arguments in Austin on October 11, 2016. The fact that the Supreme Court changed its mind and decided to hear this case is unusual and exciting.

This case began back in 2008 when TMA filed suit against the TSBEMFT asserting that by allowing LMFTs to "diagnose," the Board was authorizing them to practice medicine, which only licensed physicians have the authority to do.

TCA has been an ally of the Texas Association of Marriage and Family Therapists, which is also a named party in the suit, and stands with them in support and hope that the Supreme Court will quickly issue a favorable ruling. For more information, contact Jan Friese, TCA Executive Director.
