Holiday Construction Moratorium - 2016 Season
BACKGROUND:
The City's Engineering Department has a policy which
provides procedures for issuance of encroachment permits for construction work in the public right-of-way from Thanksgiving Day through New Year's Day. The goal of this policy was to limit disruptions to businesses during the peak shopping season and reduce traffic congestion during this busy time of year.
This policy has been in effect for over 15 years. It has proven to be a very difficult policy to carry out and looking back over the past decade has caused major complaints from the development and utility community. Over the last several years we have strived to create a better environment for our development community to work more efficiently. By lifting the moratorium, these developments could complete their projects in
a more timely fashion and keep their projects on schedule.
CURRENT POLICY:
The City of Walnut Creek does not allow non-emergency work during the winter holidays in City streets, street parking, or sidewalks located in the downtown Core Area and Ygnacio Valley Road as shown on the attached exhibit. This policy covers any work that would require an encroachment permit. Construction work located entirely on private property and not requiring City right-of-way for staging, access, or deliveries is not impacted by this policy. The moratorium period is from Thanksgiving Day through New Years Day. There are no exceptions to this policy except for emergencies and special conditions authorized by the Director of Public Works.
NEW POLICY:
We are repealing the moratorium policy for the 2016 Holiday season. Projects will be able to continue to obtain encroachment permits for sidewalk and lane closures throughout the holiday season. Each permit will be evaluated to provide balance between the need for the developer to perform their work in an efficient manner and convenience for the public. The repeal will be reevaluated in 2017 based on comments and feedback.
