ANNE ARUNDEL COUNTY

Schools Test
The City of Annapolis passed a modified APFO (Bill O-36-15) which includes a schools tests for elementary and middle schools considered closed at 105 percent of Stated Rated Capacity and Annapolis High School considered closed at 120 percent. The MBIA is opposed to this legislation from its inception in 2015 when a draft was introduced that would have created an immediate moratorium on development within Annapolis. The bill as passed includes concessions gained by the industry including a strong grandfathering provision, school capacity limits significantly higher than those initially introduced, an exception for projects of less than 12 units and carve outs for certain priority growth areas within Annapolis.
Annapolis Forest Conservation Act
Bill O-22-16, re-writing the Annapolis Forest Conservation Act was referred out of a joint committee of Economic Matters, Environmental Matters and Rules to the full City Council for a vote in September. View the bill and its related documents >>> .

Transform Baltimore Zoning Code Update
The City Council Land Use and Transportation Committee completed voting on amendments to Transform's text and tables. The Committee is now taking up Map Amendments. In the amendment process, the MBIA protected the vast majority of "permitted" uses in all areas of the City, including for residential development, in the use tables and will continue to represent the industry at every voting session to protect the significant gains made in crafting the new zoning code. No new voting sessions are scheduled at this time but the MBIA looks forward to completion of the code by the end of 2016. Please contact Josh Greenfeld

Building Relationships
Vice President of Government Affairs, Josh Greenfeld has connected and established strong relationships with every incoming member of the Baltimore City Council. These relationships will be crucial towards making sure Baltimore's strong real estate market is not hampered by excessive regulation or fees from incoming members of the City Council.

Vouchers
Baltimore County Executive Kevin Kamenetz introduced legislation requiring that all landlords in Baltimore County accept Section 8 Housing Vouchers (Bill 46-16). This legislation is commonly referred to as "source of income legislation" or at the state level, the "HOME Act." Charles County Board of Commissioners approve final Comprehensive Plan
The Board of Commissioners adopted a new Charles County Comprehensive Plan, effective July 12, 2016. The plan was approved by a 3-2 margin with Charles County Commissioners Vice President Debra Davis [D - District 2] and Bobby Rucci [D-District 4] casting the dissenting votes. The 2016 Comprehensive Plan places 180,852 acres in preservation, while limiting development. The Charles County Chapter vehemently opposed this bill as amended.

Climate Ready DC
The District of Columbia's Department of Energy and the Environment has released for comment a
draft Climate Ready DC Plan
that identifies impacts and actions to take on the District's infrastructure such as buildings and development. Comments can be made to

ProjectDox Enhancements
Effective July 25, the District's Department of Consumer and Regulatory Affairs has launched enhanced ProjectDox features that include new notifications, ability to delete uploaded files, an automatic batch approval stamp, and a supervisor project assignment feature.
Conditional Certificates of Occupancy No Longer Issued
Effective September 6, 2016, DCRA will no longer issue Conditional Certificates of Occupancy for residential or commercial occupancies. DCRA will issue CCOs only for limited activities that do not affect the general public, such as stocking a grocery store prior to its opening or for eating establishments to train staff. The
COO application
is being revised to ask a specific question about whether the applicant used a Third Party Company to conduct the inspections associated with a building permit for the subject property.
Also, the

are being revised.

DORCHESTER COUNTY

Residential Sprinkler Tax Credit
At their July 5, 2016 Council Meeting Dorchester County passed Bill No. 2016-3 Residential Sprinkler Tax Credit. This bill provides a tax credit of $5,000 or the cost of installing a sprinkler system in a new construction house whichever is less. The house must be built from July 1, 2016 to June 30, 2019. The bill is retroactive to July 1, 2016. E. Thomas Merryweather, County Attorney, said the passage of this bill does not impact the Council's efforts in seeking relief from State law.

HARFORD COUNTY

HarfordNext Master Plan
The HarfordNext Master Plan was signed into law on July 12th
. The building and development industry was well represented in supporting the Master Plan after putting out a call to members to make their voices heard. The legislation adds slightly to the development envelope although MBIA continues to push for additional expansions while also seeking reductions in Harford County's fee and regulatory burdens in order to spur economic development.

HOWARD COUNTY

Weekend and Holiday Deadlines Legislation Heard
After hearing concerns from the MBIA regarding the challenges of submission deadlines falling on weekends and holidays, County Executive Kittleman has introduced legislation, CB 51-2016, changing various deadlines that occur on weekends, holidays and government closures to the following business day. The MBIA supports this legislation and presented this testimony in support to the County Council in advance of the bill's public hearing on July 18th.

MONTGOMERY COUNTY

Subdivision Staging Policy
At its July 21st meeting, the MNCPPC Planning Board finalized its Draft Subdivision Staging Policy. The Board voted to transmit the Policy to the County Council. A resolution to adopt the Policy is on the County Council's August 2 meeting agenda with a hearing on the policy scheduled for September 13th at 7:30 PM.
SR 16-01
The PHED and Council continue to review the issues concerning use of private roads and ownership "units." Members with experience negotiating agreements with the County allowing for use of private roads with public access and use of ownership "units" are urged to report examples to the PHED Committee.
Consolidation
At its July 28th meeting, the MNCPPC Planning Board took up
ZTA-16-07
, which would allow
the consolidation of lots, parts of lots, and parcels created before 1958; and generally amend the provisions for residential lot and parcel exemptions. The Board approved transmittal to the County Council, which has scheduled a hearing at 1:30 PM on August 2nd with action tentatively following.
Prohibited Signs in Public Right-of-Way

regarding prohibited signs w
as introduced by Councilmember Leventhal to prohibit temporary signs in the public right-of-way. This ZTA can seriously impact the ability to put up temporary directional or sales signs on private property. A Council hearing is scheduled for 1:30 PM on August 2nd.
A hearing was held in July on a related bill, Expedited Bill 30-16, Streets and Roads - Amendments, introduced by Council President Nancy Floreen at the request of the County Executive. Expedited Bill 30-16 is broader in scope than ZTA 16-06. The bill clarifies that a person may not affect control over or otherwise occupy the public-right-of-way with a structure, regardless of who erected the structure. The bill also clarifies that a sidewalk and other pedestrian paths are part of the road right-of-way. The current law being amended already has provisions for temporary obstructions.

PRINCE GEORGE'S COUNTY

Prince George's County Council considers adding 2 at-large council seats
The Prince George's County Council voted to add a question to the November general election ballot that would ask residents for approval to amend the county's charter and add two at-large seats to the council. The measure would increase the number of council members from nine (9) to eleven (11).

ST MARY'S COUNTY
|
St. Mary's County suspends cap on residential development
The St. Mary's Board of County Commissioners voted to suspend the county's cap on residential development. Department of Land Use and Growth Management recommended that the Commissioners rescind the policy because it was no longer needed. In 2008, the Board of County Commissioner established a 1.9 percent cap on residential growth in St. Mary's County.

WICOMICO COUNTY

CAFO
The Wicomico County Council will review the recommendation of the Wicomico County Planning and Zoning Commission on changes to the zoning code for Concentrated Animal Feeding Operation at their August 2, 2016 meeting.
Development Approval
Salisbury City Council has approved the development of two waterfront parcels at the Port of Salisbury Marina. The parcels will be developed with a mix of commercial and residential units. The architect for the project estimates it will take 12 months to develop a site plan and 24 months to get the necessary city and state permits.

WORCESTER COUNTY
|
Rezoning
The Worcester County Commissioners have rezoned 95 acres on the northwest side of Beauchamp Road (Former Pine Shore Golf Property) from E-1 Estate District to R-1 Rural Residential District. This allows the property to be divided into 85 building lots. Sewer and water for the property will be provided by Ocean Pines.
The Town of Ocean City has rezoned the Cropper Concrete Company plant on St. Louis Avenue from manufacturing (M) to inlet (I-1). The Ocean City Planning and Zoning Commission endorsed rezoning the property to accommodate a hotel and Ropewalk restaurant. The building was approved to be eight-and-half stories tall.
Berlin Mayor Candidates
To date Elizabeth Anne Hall has filed to run for Mayor of the Town of Berlin and District 2 council member, Jack Lee Orris, Jr. and Zachary Charles Tyndall have filed to run for District 2. Additional candidates have until September 2 at 5 pm to file for the election.

NAHB has developed two new FAQs to help members comply with the EPA Lead; Renovation, Repair and Painting Rule. The first document addresses inspections and the second tackles recertification.
RRP Certification/Recertification Q&A is an updated resource compiling information on firm and individual renovator certification and training requirements, including recent EPA action that modified the requirements of the refresher training which certified renovators must take to maintain their certifications.
Maryland Pilot Program for Community Solar Energy Generating Systems
The Public Service Commission has finalized, with changes, regulations for a pilot program designed to make solar energy available to electric customers throughout Maryland through subscriptions to community solar energy generating systems. The regulations were proposed in the April 29
Maryland Register
and the adoption with changes announced in the July 8 Register.
The U.S. Environmental Protection Agency has released the report, Stormwater Management in Response to Climate Change Impacts: Lessons from the Chesapeake Bay and Great Lakes Regions (EPA/600/R-15/087F). The report provides insights gleaned from workshops and assessments EPA and the National Oceanic Atmospheric Administration held with local planners on ways to further the adoption of climate change adaptation practices in stormwater management.
