Temporary Protected Status to End for El Salvador

The U.S. Department of Homeland Security (DHS) has announced that it is ending Temporary Protected Status (TPS) designation for citizens of El Salvador on 07/22/2019.

As an employer, you may not even know if you are employing a Salvadoran citizen under TPS.  To date, these individuals have been authorized to work in the U.S. pursuant to EAD cards with a designation of either (a)(12) or (c)(19).  However, these designations are also used for TPS for individuals from other countries for which TPS is not ending.  Consequently, you may not even know if you are employing individuals under TPS until you seek to re-verify their I-9, the Employment Eligibility Form, and the employee is unable to provide a new EAD card.
