Misinterpretation can be costly, and once signed you limit your options for making changes later.

The day has finally come.  You've signed every last closing document and you're standing in the living room of your new home.  You make your way into the kitchen and you realize it looks different.  There is a gaping hole where the stainless steel, Wi-fi-enabled  refrigerator once stood.  It had been a major selling point.  You were torn between this home and a similar one down the street, but this one had the awesome frig and outdoor, custom fire pit.  You look outside to check for the pit and there it is, a perfectly round patch of scorched earth.  
 
It's no secret that social media and the internet have drastically changed the way real estate is bought and sold.  More often than not, people are starting their search online.  Buyers scour MLS listings, brokerage-firm websites, social media posts and sites such as Zillow and Trulia to learn more about properties. Just because an item appears in the listing, doesn't necessarily mean it is included.  If it's not in the written contract between the buyer and seller, it can become a problem.  

The message to buyers and sellers is simple:  Avoid heartaches, headaches and complaints by b eing sure to discuss these subjects with your agent and reducing the exact agreement of the parties in writing, even when it comes to refrigerators and fire pits.

Buyers, Sellers both have options when home inspector finds problems.


 
You have signed a purchase contract for a home and made your offer contingent upon getting a satisfactory report from a home inspector.  The inspection report states the home has major plumbing problems, which will cost about $6,400 to repair.  Is the seller required to pay for the work because your offer was contingent on an inspection?

The answer is no.  The seller is not obligated to make the repairs in order to close the sale.

An inspection contingency allows buyers to cancel a sale and get their deposit/earnest money back if the report uncovers previously undetected problems, such as a badly leaking roof or a plumbing system that needs a complete overhaul.  It does NOT, however, require a seller to fix any problems that the inspector might find.  When problems are discovered, buyers have four basic options:

  • Renegotiate with the seller to have the needed repairs made before close.
  • Ask for a lower sales price so the buyer will have the money to make the repairs after moving in.
  • Purchase the property "as is".
  • Cancel the sale and have their deposit/earnest money returned.

If you still want the house, contact two or three professional plumbing companies and ask for written estimates for the cost of the work.  Then, you can show these bids to the seller in an effort to make him pay for some or all of the work, or to maybe lower the price so you can afford to take care of the problem after you move in.

If the seller won't renegotiate, you'll have to decide if you accept the home in its current condition and pay for the repairs yourself, or to instead exercise your contingency to cancel the sale and demand that your deposit/earnest money be returned.

Desoto Marina & Waypoint - 120 Marina Road
Fall/Winter Hours: The Waypoint is now open seven days a week from 9 a.m. - 4 p.m., with grill items available from 10 a.m. - 2 p.m. Hot dogs and chicken salad may be purchased until 4 p.m. Watercraft may be rented at the marina until 2 p.m. so that rental items may be used and returned by 4 p.m. 


Lake DeSoto Sunset Cruises:  DeSoto Marina now offers Sunset Cruises on Tuesday and Thursday evenings, beginning at approximately 30 minutes before sunset. There is a four guest minimum and eight guest maximum per cruise. Exact start times vary depending on the time of sunset on a given day. The cost is $10 per person. To arrange a cruise or to inquire about times, please call DeSoto Marina at 501-922-5511.

Bacon Penne Alfredo

Ingredients
16 ounces uncooked penne
1 (16oz) pkg. sliced bacon
1 (8oz) package sliced fresh mushrooms
2 garlic cloves, minced
1 cup grated parmesan
2 cups whipping cream
1/2 tsp. pepper
1/2 cup sliced green onions

*Cook pasta according to package directions.  
 
*Cook bacon in a large skillet until crisp, drain on paper towels.  Reserve 2 tablespoons of drippings in skillet.  Crumble bacon and set aside.
 
*Saute mushrooms and garlic in hot drippings for about 3 minutes or until tender.
 
*Stir in pasta, Parmesan cheese, whipping cream and pepper.
 
*Reduce heat to medium-low; simmer, uncovered, until sauce is thickened, stirring often.

*Stir in crumbled bacon and sliced green onions; serve immediately.

**Makes 4 to 6 servings**

GOLF DEPARTMENT 

Golf Course Maintenance: As the temperatures drop, it signals the beginning of the season where frost delays may occur. Frost is frozen dew that has formed on the grass, making it hard and brittle. When frost is present, Golf Course Superintendents delay play until the frost has melted. This is done to prevent damage that affects the quality of the playing surface and could potentially be very expensive to repair.

Shotgun Season: This will begin on Wednesday, December 1. Balboa, Granada, and Magellan golf courses will start at 11 a.m. each day. Please see member portal for instructions on lottery requests during shotgun season. 
 

Twilight Golf:   Twilight golf now begins at 1:00 for members and 2:00 for the public.   The Twilight rate will be offered to members, their families, and accompanied guests.
 
On-site Golf Cart Service: Jerry Pate Company will offer specialized preventive maintenance service for members with private golf carts, at Magellan Golf Club, on Wednesday, January 10, by appointment only.  Click here to review services and costs. Email [email protected] to pre-register.

Medical Flags:  To save property owners money, Medical Flags will no longer be needed. After discussions with members, Director of Agronomy Gary Myers, the Golf Committee and the Golf Department, we will give golfers more opportunities to ride on the golf courses, weather permitting. The discontinuation of the Medical Flag program is not the removal of a benefit, but rather represents a choice not to charge anyone for a flag that does not provide an added value as a return on the expense. 


HSV State Weeks: 
Invite your friends and family to play and save in Hot Springs Village! Guests who play during their designated state's week play at member rates. This includes golf fees, fitness center day passes and tennis court reservations. The 2017 HSV State Weeks calendar is available online.

Nine Hole Reservations:
Golfers may now book 9-hole tee times in advance of the day of play beginning at Noon (12:00 p.m.) the day Prior to The Day of Play. For reservations you may call Central Tee Times at 501-922-2858 or the Pro Shops. The fees will be 9-hole green fees and 9-hole cart fees
