As we enter February, I hope this note finds everyone off to the start of a wonderful new year. The HCBA Holiday Reception was once again a success and it is always a great opportunity to catch up with friends to celebrate the season. Thanks to Mary Lou Wellman for spearheading another enjoyable event.

The HCBA also held its Bench Bar Conference on January 18, 2018, the theme of which was "Alternatives to Traditional Incarceration." Special thanks to HCBA board members David Stock and Jason Hart for the informative program on pre- and post-trial alternatives.

We hope you will be able to join us for our Spring Luncheon, which will be held on March 22 at the Westwood Club, where founding father Patrick Henry will be joining us. See the "Patriotic Guest" article below for more information. Upcoming events also include our Legislative Update, on May 3 at the Westwood Club, as well as our Annual Reception, on May 10 at Lewis Ginter Botanical Garden.

We also wanted to take a quick opportunity to recognize the very good work done by the Virginia chapter of Lawyers Helping Lawyers, which is entering its fifteenth year of helping those in our profession dealing with stress or impaired by substance abuse. Finally, the University of Richmond Law School is looking for lawyer volunteers to judge their 1L Moot Court Competition the week of March 19. I hope you will consider donating your time and energy to the ongoing education of our next generation of young lawyers. Holiday Reception

The annual HCBA Holiday Reception took place on December 7, 2017, at Willow Oaks Country Club. Dozens of Henrico County attorneys and judges, and their families, came together for an evening of holiday cheer. The Flying Sulsers provided festive holiday music while members enjoyed food, fun and fellowship. The HCBA would like to thank Planet Depos and Superior Document Services for sponsoring the event. Our sponsors are a critical part of our success, and we encourage members to use their services to show thanks for their continued support of our events. Bench Bar CLE
 
The 2018 HCBA Bench Bar Conference took place on January 18, 2018, in the Henrico County Board Room. The topic of the 2018 event was "Alternatives to Traditional Incarceration," and featured speakers from several of the participants in the county rehabilitation community.

Sheriff Michael Wade and members of his office discussed the RISE and ORBIT programs available for inmates of the Henrico County Jail. The requirements of each of these programs were discussed along with expectations for the participating inmates. 

Bernard Green, the Administrator of the Henrico County Drug Court, educated attendees on the people who are eligible for that program, the five phases of the program, and the typical time participants need to complete the program successfully. 

Amy Cliborne from the Virginia Department of Corrections presented information on the new Community Corrections Alternative Program (CCAP). This program is designed to serve non-violent felons who need more supervision than probation can provide; but, may benefit from less supervision than traditional incarceration. CCAP programming provides substance abuse evaluation and treatment, job training, and cognitive behavioral treatment to participants. 

The Hon. Richard S. Wallerstein of the Henrico Circuit Court gave attendees the Bench's perspectives regarding alternative programs including what considerations judges make when deciding whether a person is a good candidate for alternative sentencing programs.

Best Thing About Practicing Law in Henrico:  The positive working relationship we have between prosecutors and defense attorneys. We don't always see eye-to-eye and we both do our jobs, but in my experience, we treat each other with respect. Coming from Northern Virginia, where I practiced for a few years after law school, I can tell you that this kind of working environment is not universal.
 
Funniest Experience as an Attorney:  I once had a defendant in a homicide case put on a provably-false alibi.  He had the dates wrong, so his alibi proved that he wasn't at the murder scene the week after the murder. It was one of those rare lucky breaks you sometimes get in trial work. As I often say, if defendants didn't make mistakes, our job as prosecutors would be much more difficult.
 
Advice to Young Attorneys:  Your reputation for integrity, good or bad, will affect your entire career. Work every day to enhance yours, and protect it zealously. And return phone calls and emails-promptly and regularly.

One Thing You Might Not Know About Me:   While I love my alma mater Emory & Henry College and it changed my life, I only went there in a twist of fate because my first choice sent me the wrong letter in the mail!  By the time they called me to apologize two months later I had already paid my deposit and accepted admission to Emory & Henry. It turned out to be one of the best things to ever happen to me, but I sometimes wonder where my life would have taken me had that person hit the correct button on the computer when printing letters. 
 
Best Thing About Practicing Law in Henrico:  The collegiality of the Bar and the Bench. Everyone, at least in my line of work, seems to get along well. People are very polite to each other. The Judges and opposing counsel are accommodating with extensions of time and other matters that are discretionary. 
 
Funniest Experience as an Attorney:   Getting profiled in the county bar newsletter!
 
Advice to Young Attorneys:  Carry your business cards 24/7. Business isn't going to come to you magically. You need to get out there, network, and build your brand. It doesn't matter if you are at a two person firm or downtown, eventually you will be expected to bring in business of your own. So start early!

Patriotic Guest for HCBA's 2018 Spring Luncheon

Just one year before drafting the Declaration of Independence, Thomas Jefferson, George Washington, and other key revolutionary figures gathered for the Second Virginia Convention held inside historic St. John's Church in Richmond.  They all listened as Patrick Henry delivered his now-famous "Give me liberty or give me death" speech, which is considered one of the key catalysts for the Spirit of '76 and our Nation's fight for independence.

At the HCBA's Spring Luncheon on March 22, 2018, at 12:00 p.m., Patrick Henry, portrayed by Michael Owens, Esq., will join us to share parts of his patriotic speech, as well as his authentic musings on the Bill of Rights and his interactions with other key historical figures and events of the time. For anyone who has seen Mr. Owens as Patrick Henry at St. John's Church, you know that he will deliver a spirited portrayal of one of Virginia's most famous revolutionary sons.

We hope that you can join us at the Westwood Club for this presentation on March 22. We fully expect it will stoke the continuing pride that we all share in our history and Virginia's key contributions to the American Revolution. We deeply appreciate SELTEK sponsoring this event and making it possible for us to bring Patrick Henry to the HCBA. Golf Tournament Survey

We are reaching out to gauge interest in continuing the annual golf tournament. In the past, the HCBA has hosted an annual golf tournament supporting charity. Last year, we had to cancel the event last minute due to lack of registrations. For those of you who do care about this event and would like to attend, please contact us at  [email protected]  to voice your position. Please include "Golf Tournament " in the subject line. We also welcome thoughts on improving the event. Please respond with your interest in a timely fashion.

Ethics CLE

On October 30, 2017, Virginia State Bar Ethics Counsel, James M. McCauley, presented on "Hot Topics in Legal Ethics" to approximately seventy HCBA members and non-members. The engaging seminar discussed ethical issues associated with lawyer lobbyists, lawyer impairment, client/witness perjury, cyber security, lawyer advertising and attorney-client matching services. The HCBA is proud to offer quality CLE programming at no cost to our members. We thank Mr. McCauley for his informative and engaging presentation.

Drug Court News

On behalf of the Honorable Judge Gary A. Hicks and the Honorable Judge John Marshall we are proud to announce the 15th Anniversary of the Henrico County Drug Treatment Court! This is a huge milestone and we'd like to thank the Henrico County Bar Association for its ongoing support of our program and its endeavors.

One of those endeavors is our Turkey Tuesday Drive. Since 2010, through the generous donations of community partners, like you, we have been providing Thanksgiving dinners to our participants and their families. This past Thanksgiving with your help we provided meals for 22 active participants. On their behalf, we'd like to say THANK YOU!

On January 18th we had the pleasure to meet with members of your association to discuss alternative sentencing programs available here in the county. Mr. David Stock extended the invitation and we greatly appreciated the opportunity to provide information to your members regarding our program and the services that we provide. The following day, January 19th, we kicked off our 15th year anniversary celebration with a Drug Court graduation. Thirteen participants completed our program, our largest graduating class to date, bringing our 15 year total to 196 successful graduates!

We were honored to have Mr. Wilbert Harris as our guest speaker, a graduate of our 1st graduating class in 2004. It was great to have Mr. Harris share with us about his time as a participant as well as his ongoing recovery journey which includes being an active member of our alumni and advisory board. To make this commemorative event even more noteworthy was the opportunity to make two special presentations during the ceremony; the awarding of our 1st Alumni Challenge award and the honoring of our administrative assistant who has been with the program since its inception.

The Alumni Challenge was created to promote ongoing recovery efforts of our participants and to further enhance participation in our alumni association. The challenge awards $200 to any graduate who commits to random, monthly drug tests for 12 months post program completion. Brittany Welsch, who graduated in January 2017, was the recipient of this award. Brittany continues to participate in alumni related events with our program and has also been hired as a Peer Recovery Specialist with Henrico Mental Health's Outpatient Program; we could not be more thrilled with her success. Our second presentation was to Ms. Secret Hatchett, our administrative assistant. Judge Hicks presented Ms. Hatchett with a bouquet and paid tribute to her tireless efforts in support of our program.

Our plans are to continue celebrating our anniversary at each of our graduations this year by inviting founding members of our program as well as our alumni to participate in our graduation ceremonies. The Honorable Judge Catherine C. Hammond, one of the founding judges of our program, has agreed to be our speaker in May, National Drug Court Month. We would love for you to be in attendance and hopefully witness the graduation of our 200th graduate!

Alumni Challenge

VSB Bar Council

Your Henrico County representatives on the Virginia State Bar Council will meet February 24 in Richmond. If you have any concerns over the management or business of the VSB, we would be interested in hearing from you.

Client's Protection Fund
On October 27, 2017, Bar Council unanimously approved a request from the Client's Protection Fund Board to allow the Bar to seek an extension of the CPF's current sunset provision from July 2020 until July 2023. The Supreme Court has approved Council's move and the VSB is now pursuing the extension at the General Assembly.

Emeritus Rule/Pro Bono
Council was also unanimous in approving a proposal by the Special Committee on Access to Legal Services to permit emeritus members of the VSB to provide pro bono services without direct oversight by a supervising attorney. The Supreme Court approved Council's action in a December 29, 2017, order.

Fee Sharing/Referral Services LEO
A Legal Ethics Opinion (#1885) was approved by Council by a vote of 59 to 6 that concluded that lawyers cannot participate in attorney-client matching services under the facts presented in the opinion because the action would violate rules on fee sharing with non-lawyers, paying for referrals and safeguarding client funds. That LEO is still with the Supreme Court for consideration.
