The Department of Technology of the City and County of San Francisco has issued a
Request for Qualifications (RFQ) to pre-qualify firms to submit proposals pursuant to a subsequent RFP to design, build, finance, operate and maintain a citywide fiber to the premises network, lit fiber and Wi-Fi services project. RFQs are due at Noon PT on March 26, 2018.

INCOMPAS' Kronenberg Talks
Net Neutrality at Congressional Internet Caucus Event

On February 12, INCOMPAS Chief Advocate and General Counsel Angie Kronenberg (at left in photo above) participated on a panel entitled "What's Next For Net Neutrality? Litigation, Legislation, and the Lay of the Land," hosted by the Congressional Internet Caucus Academy.
Kronenberg said that "we need to focus on the facts, and we have a long record of what they are. Net neutrality protects consumers and businesses." She noted the open internet protections have long been supported on a bi-partisan basis by lawmakers, regulators and voters. She added that actions being taken in Congress, as well as in the states where new legislation and executive orders have been announced, are in direct response to the Commission's decision in December to roll back the protections.
Kronenberg also questioned whether the FCC's order will preempt state efforts to protect an open internet, particularly those that have used executive orders that condition state contracts so that only those ISPs that are willing to abide by open internet principles may serve as a communications provider for state agencies.

Net Neutrality Actions on
Capitol Hill and in the Courts

In a February 13 letter to FCC Chairman Ajit Pai, 24 Democratic members of the House Energy and Commerce Committee requested information on how the Commission reviewed public comments in the Restoring Internet Freedom proceeding. They asked the Commission how it determined which comments were non-substantive, the number of consumer comments filed in the record and how it determined which arguments filed by Congress not to consider. They requested a response by March 6, 2018.
Earlier this month, the FCC filed three motions with the D.C., First and Ninth Circuit Courts, seeking to dismiss petitions for review of the Restoring Internet Freedom Order filed by New America Foundation's Open Technology Institute (and consolidated cases), the County of Santa Clara, et al. and Free Press. The Commission asserted the petitions are premature because the Order results from a rulemaking proceeding and a summary of the Order and the text of the amended rules have not yet been published in the Federal Register. |

President Trump's FY19 Budget Includes Infrastructure Plan

President Trump released his FY 2019 budget proposal on February 12, which included his plan for rebuilding America's infrastructure. The $200 billion infrastructure plan includes:
- $50 billion for a rural infrastructure program that would distribute funds to the states as block grants to be used for infrastructure projects in rural areas with populations of less than 50,000
- $14 billion from an infrastructure financing program would go to expanding a number of existing credit programs, including TIFIA, WIFIA, RRIF and RUS.

| In a recent Public Notice, the FCC announced that the next meeting of the Broadband Deployment Advisory Committee (BDAC) will be held on April 25, 2018. The BDAC will consider reports and recommendations from its working groups, including the Model Code for Municipalities working group and the Model Code for States working group. The BDAC also will continue its discussions on how to accelerate the deployment of broadband by reducing and/or removing regulatory barriers to infrastructure investment. |
