So far IACP has been really busy this year.  We have already shared with you quite a few programs - and we aren't done yet!

We have done a look back at what we accomplished together in 2017 and shared our plan for 2018, along with my EVP message to membership.  We have highlighted our amazing Committee Chairs and their goals for the year that are driven by YOU, IACP's members.  We have a new energy and passion that is tangible and really shines through with every committee meeting, board meeting, member engagement and certainly, at the staff level.

The IACP COMP PAC Newsletter came out with a teaser on the upcoming COMP PAC Tiers.

The new Executive Membership is now available and opened with a fantastic response.  The day it was released we got our very own, IACP President-elect Jennifer Burch to sign up.  A couple days later, IACP Vice President and IACP COMP PAC Chair, Shawn Hodges, joined the fun.  Now, we can add IACP Board Member and Infrastructure Review Committee Chair, Jeffery Bray, as our THIRD Executive Member!

Corporate Member Tiers were announced on Monday this week!  We are excited to recognize and thank our Corporate Members for all their support.

  • Doug Yoch, IACP Board Member and IACP Membership Committee Chair recently spoke to pharmacy students at University of South Carolina (USC) during their Pharmacy Day.  Doug, an alumni of USC, had an opportunity to share more about IACP and why membership was important.  While he was there he got 15 new pharmacy student members signed.  Thank you, Doug!
  • Lauren Aller, IACP Member, will be speaking and helping IACP exhibit at the LP3 Network has asked IACP to speak and exhibit at their Student Compounding Competition held in Aventura, FL on March 17th - 18th.  This is another wonderful opportunity to work with students and share more about IACP and what incredible benefits IACP offer to students including a FREE student membership!  
  • IACP will be attending the PCCA ACT Legislative Conference in Washington D.C. on April 18th - 19th as well. The conference begins with a half day of educational programming on Wednesday afternoon followed by an opening dinner, a legislative breakfast on Thursday followed by Congressional visits and a closing reception.

Your Presence is Needed at CCH!

As a former Congressional staffer in the U.S. Senate and U.S. House of Representatives, I am often asked why storming the Hill during 
Compounders on Capitol Hill (CCH) is so important and whether it's worth your time away from patients and your pharmacy. My answer is a resounding YES and here's why.

I've been on the other side of the table from you with the Senator and Congressman for many years during fly-ins on the Hill. Every other day, we met with lobbyists and attorneys and not to say that isn't important - but  no one can represent YOUR voice and the voices of your patients like YOU. If you aren't showing up, you are gambling that someone else will represent your voice, your passion for preserving your industry and patient access, and share your personal stories - and that's a dangerous gamble to make. We have an incredible government affairs team at IACP that we are grateful for, but as they would also admit as former Congressional staffers - no voice is as powerful as YOUR voice. Compounding is personal and so are your stories and the stories of your patients.

Your Voice Matters - Your Vote Matters: The most common misconception I saw as a Congressional staffer was that pharmacists didn't understand how powerful their voice was and what makes them different from their opposition.  YOU have something that no one else has - YOUR vote which spans in every Congressional districtYou are a constituent; your patients are constituents and the providers you work with are constituents - and, constituents vote during elections, they tell those they work with, their families, and their friends how to vote as well. In times like these when our opposition is actively working against us on a daily basis - it's important to keep in mind that none of our opposition has this benefit that you have - but you have to make that benefit count. It's what makes you different and it's what makes YOUR presence as we Storm the Hill and walk the Halls of Congress at CCH so important.
 
If you are new to Hill day or feel that you want to ensure someone that is a Hill veteran goes to the Hill with you, don't let this hold you back! We have added an option on the registration form where you can let us know! We have a vast army of volunteers from former Congressional staff, Corporate Members, and other Hill day veterans lined up ready to storm the hill with you!

We are also going to shake it up this year with some incredible competitions coming your way for those who get the most folks to CCH! We have some amazing prizes and awards in store! Stay tuned next week for the launch of these competitions and more information! No one's voice is more powerful than your voice on Capitol Hill and in getting your colleagues to join us at CCH!

IACP Responds to New Pew Report on State Oversight of Compounding


On Monday, February 26, 2018, The Pew Charitable Trusts has released a Report entitled, State Oversight of Drug Compounding: Major Progress Since 2015 but Opportunities Remain to Better Protect Patients. The report claims to provide an overview of the current landscape of sterile compounding oversight by analyzing quality standards, state challenges, office-use, sterile compounding, and in-state pharmacy inspections. However, the report is comprised of a multitude of inaccurate information and data with very little input from State Boards of Pharmacy.  The full Pew report can be read  here  and the press release can be accessed  here . Associate Attorney General Brand Announces End To Use of Civil Enforcement Authority to Enforce Agency Guidance Documents


On Thursday, January 25th, the  Associate Attorney General  issued a memorandum that prohibits the Department of Justice from using civil enforcement authority to "convert agency guidance documents into binding rules."  According to the Memorandum published on the Department of Justice website, Justice Department civil litigators are prohibited from using guidance documents - or noncompliance with guidance documents - to establish violations of law in affirmative civil enforcement actions. Further, in that same news release, DOJ Associate Attorney General Brand stated "Although guidance documents can be helpful in educating the public about already existing law, they do not have the binding force or effect of law and should not be used as a substitute for rulemaking." 

PLEASE NOTE: IACP currently is reviewing this information and determining what impact this has for current FDA Guidance for Industry (GFI) documents. IACP will send you additional updates as they become available.

Other DOJ News


As one of her final acts before leaving DOJ, Associate Attorney General Rachel Brand  announced that DOJ would no longer permit its lawyers to use guidance documents issued by its "client" agencies as a basis for civil enforcement. The "Brand Memo" provides guidance about DOJ's use of guidance, as we described  here.
 
In a couple of coordinated speeches, DOJ officials reiterated and clarified this position. Deputy Associate Attorney General Stephen Cox, who worked closely with Rachel Brand, spoke at the Federal Bar Association Qui Tam Conference on February 28, 2018. Cox described federal agencies' use of guidance in lieu of formal regulatory rulemaking required under the Administrative Procedure Act: "Rulemaking can be cumbersome and slow, of course, and sometimes agencies have used guidance as a short-cut to effectively make new rules when they should have undertaken notice-and-comment rulemaking instead." He referenced a recommendation from the Administrative Conference of the United States (ACUS) to make clear that "the public may take a lawful approach different from the one set forth in" a guidance document. Per Cox, the Brand memo implements the ACUS recommendation: "The Brand Memo makes clear that we won't be using noncompliance with a guidance document to prove a violation of the applicable statute or regulation. In other words, we won't use our affirmative civil enforcement authority to effectively convert a nonbinding guidance document into a requirement that has the force or effect of law."

    • Researchers at Oregon State University have made a key advance in the fight against drug resistance, crafting a compound that genetically neutralizes a widespread bacterial pathogen's ability to thwart antibiotics.

    The Pew Charitable Trusts and the National Association of Boards of Pharmacy in a report released Monday (Feb. 26) praise states for implementing what they believe are best practices in overseeing compounding, but they say more can be done to increase inspection frequency and develop a risk-based inspection framework. Since Pew's last survey in 2015, more states have adopted United States Pharmacopeia standards for compounding and many have worked to harmonize their state regulations with federal law, but inspection frequency has gone down.  To read more click  here .


    Bloomberg - States, FDA Limit Access to Compounded Drugs, House Republican Says

    • Report says 39 states and D.C. don't permit traditional pharmacies to compound drugs for office use
    • Republican lawmaker is concerned that patients won't have access to the medications they need
    (Bloomberg Law) -- Traditional compounding pharmacies should be allowed to compound medications without prescriptions for use in doctor's offices, Rep. Buddy Carter (R-Ga.) told Bloomberg Law Feb. 26.  Thirty-nine states and the District of Columbia currently don't permit such office-use compounding and 11 states allow it, according a report released Feb. 26 by the Pew Charitable Trusts and the National Association of Boards of Pharmacy (NABP). This contrasts to 2015, when Pew said two-thirds of states allowed office-use compounding to some extent. Office-use compounding is when a pharmacist makes a drug without receiving a prescription and transfers it to a requesting physician to keep on hand for when it's needed by a patient. To read more click here.

    Chapters <795> and <797>

    USP General Chapters <795>   Pharmaceutical Compounding - Nonsterile Preparations , and <797>   Pharmaceutical Compounding - Sterile Preparations   are in the active revision process. The purpose of this alert is to provide you details of upcoming opportunities where you can participate in the public comment process for the proposed revisions.   
     
    To provide a unified approach to quality compounding, USP intends to align the timing and content of General Chapters <795>, <797>, and <800>Hazardous Drugs-Handling in Healthcare Settings.   Among other proposed content in the revisions, hazardous drug handling sections in <795> and <797> will reference General Chapter <800>.
     
    General Chapter <800> was completed and published in February 2016, and the content of that chapter is not currently under revision.
     
    Below are the timeline and associated web links for you to engage and provide input during the public comment periods for <795> and <797>.  You will be able to provide written comments through the USP website from March 30, 2018 to July 31, 2018 for USP <795>, and from July 28, 2018 to November 30, 2018 for USP <797>.

    The  International Academy of Compounding Pharmacists (IACP)  has submitted formal comments to the  Kansas State Board of Pharmacy  on  Proposed Regulations K.A.R. 68-13-2, 68-13-3, and 68-13-4.   The March 5, 2018 submission reflects IACP's continuing effort to respond to each and every state action impacting pharmacy compounding. IACP will continue these efforts and will work closely with State Pharmacist Associations and State Boards of Pharmacy to support all state action preserving patient access to compounded medications. The  IACP Legislative Committee  chaired by  IACP Board Member Anthony Grzib, RPh  is continuing to look for additional ways IACP can engage in preserving patient access to compounded medications.

    The International Academy of Compounding Pharmacists (IACP) represents more than 4,000 pharmacists, technicians, students, and members of the compounding community who focus on the specialty practice of pharmacy compounding. Compounding pharmacists work directly with prescribers including physicians, nurse practitioners and veterinarians to create customized medication solutions for patients and animals whose health care needs cannot be met by manufactured medications. IACP works diligently to preserve patient access to these vital compounded medications.
     
    IACP would like to thank the Kansas Board of Pharmacy for this opportunity to present thoughts on the proposed K.A.R. 68-13-2, 68-13-3, and 68-13-4 (Proposed Regulations)IACP supports the Kansas Board of Pharmacy's mission to ensure that patients throughout the State of Kansas receive safe, effective and quality compounded medications. IACP understands and supports the need to protect public health. When developing and implementing regulations, it is essential to preserve patient access to vital compounded medications, the prescriber-patient pharmacist triad, and the right of a patient to choose their pharmacist. Prescribers must have the right to prescribe medications that best fit the needs of their patients.
     
    IACP has reviewed the Proposed Regulations and would like to provide the following stakeholder input. IACP has heard from pharmacists as well as prescribers who will be impacted by the Proposed Regulations when compiling this input.
     
    First, IACP commends the Board for recognizing the need for pharmacists to provide both sterile and nonsterile compounds to prescribers for office-use. Pharmacists' ability to provide compounded medication for prescribers to use within their practice setting is critical to patient care.  
     
    Second, while IACP supports the Board's intent to create compounding standards consistent with U.S. Pharmacopeia (USP) requirements, IACP is concerned that certain portions of the Proposed Regulations are inconsistent with current standards found within USP General Chapters <795> and <797>, such as:
    • Defining terms or compounding categories within K.A.R. 68-13-2 that either do not exist within <795> and <797> or conflict with the current USP definitions.
    • Imposing restrictions on the use of compounding ingredients within K.A.R. 68-13-3 which currently do not exist with <795> and <797>.
    • Creating beyond use dating requirements within K.A.R. 68-13-3 and 68-13-4 that are unclear and potentially more restrictive than those found in <795> and <797>.
    • Establishing sterile compounding risk categories within K.A.R. 68-13-4 that conflict with each other and are inconsistent with those established within <797>.
    In order to best preserve patient access to vital compounded medications, IACP urges the Board to make revisions to specific sections of the Proposed Regulations (see attached), along with the remainder of K.A.R. 68-13-2, 68-13-3, and 68-13-4 to align the Proposed Regulations with the current standards found within USP <795> and <797>.

             IACP appreciates the opportunity to present its perspective to the Kansas Board of Pharmacy and is available to answer any questions the Board may have.     • IACP Submits IL Comments!  IACP submitted formal comments to the Illinois Department of Financial and Professional Regulation on Proposed Amendments to Regulations Implementing Illinois Pharmacy Practice Act. 
    IACP Comments Excerpt:   
    IACP would like to thank the Illinois Department of Financial and Professional Regulation 
    ("IDFPR") for this opportunity to present thoughts on the proposed amendments to Section 1130.640 of the Illinois regulations implementing the Pharmacy Practice Act (the "Proposed Rules"). IACP supports the IDFRP's mission to ensure that patients throughout the State of Illinois receive safe, effective and quality compounded medications. IACP understands and supports the need to protect public health. When developing and implementing regulations, it is essential to preserve patient access to vital compounded medications, the prescriber-patient-pharmacist triad, and the right of a patient to choose their pharmacist. Prescribers must have the right to prescribe medications that best fit the needs of their patients. 

    IACP has reviewed the Proposed Rules and would like to recognize the IDFPR for incorporating much of the stakeholder input submitted during prior comment and review periods. IACP has heard from pharmacists as well as prescribers who will be impacted by the Proposed Rules that specific provisions still exist within the Proposed Rules that need further clarification or will cause unnecessary constraints in patients being able to access needed compounded preparations. 
     
    First, IACP had the opportunity to review the recommendations being submitted by the Illinois Pharmacists Association ("IPhA") and would like to express support for the IPhA's proposed modifications to Sections 1130.640(c),(d),(e), and (f) of the Illinois regulations. IPhA's proposed changes are necessary to ensure that these portions of Section 1130.640 incorporate consistent practice requirements that align with United States Pharmacopeia ("USP") General Chapters 795 and 797 standards currently governing compounding pharmacies. The IPhA's recommendations in these areas will safe-guard patient safety and place the Proposed Rules in line with best practices while also preserving patient access to compounded medications.     • House and Senate pass legislation to rein in pharmacy benefit managers

    On Wednesday, both chambers of the Arkansas legislature approved identical versions of a bill to regulate pharmacy benefit managers, the powerful healthcare companies at the center of a dispute over cuts in reimbursements paid to pharmacists. Governor Hutchinson has committed to signing the legislation, which sponsors say is likely the first of its kind in the nation.

    Senate Bill 2 passed in a floor vote of 30-2, with all members voting; the 35-seat Senate currently has three vacancies. House Bill 1010 passed its chamber, which has one vacancy, by a vote of 92-2, with two members voting "present" and three not voting.

    The General Assembly is meeting for a three-day special session that was called by Hutchinson on Monday to address the PBM issue and a grab bag of other bills. The session was expected to wrap up on Thursday. To read more click here.
    • Arkansas pharmacists call out PBM abuses: In anews conference this past week, the Arkansas Pharmacists Association shed light on several egregious PBM abuses, including reimbursement cuts in the Arkansas Works program and price differences between what PBMs pay their own pharmacies and what they pay independent pharmacies for the same claim. As APA's Scott Pace said: "Pharmacists take care of people, folks, and that's what they're trying to do ... The situation is unsustainable and it requires a fix." Please take a moment to listen to this conference and share with your colleagues.
    • AVAILABLE FROM IACP! State-by-State Analysis of Office-Use Compounding Regulations! Your Government Affairs team just released a State-by-State Analysis of Office-Use Regulations! We researched State regulations, State notices, State activity, and called State Boards of Pharmacy when regulations conflicted with actions to determine each State's office-use actions. In the instance where a State had recently changed its office-use practices, we called to determine why, and the response was noted when FDA had communicated that State law was pre-empted with Federal law.
    You will find two documents - (1) the State-by-State analysis and (2) a complete supplemental document where all State regulations and actions are housed. The State-by-State analysis is a quick reference guide that demonstrates State regulations and current thinking on office-use and all supporting documents to this research can be found in the supplemental document. The DQSA Coalition intends to use this document to see whether model office-use State laws exist, to educate and assist States that are attempting to change office-use practices on the intent of Congress, and to focus on specific states for the State Board of Pharmacy/Board of Medicine Coalition Letter that is coming soon!    
    • USP General Chapter <800> State Adoption Status Chart. NASPA has developed a chart providing each state's current adoption status of USP's General Chapter <800>. Thank you, IACP Affiliate NASPA, for developing this invaluable tool!

    14th Annual Rx Mixer: Aloha State of Mind

    The ONLY IACP Foundation fundraiser of the year and helps support the Foundation's invaluable mission!
