By direction of President Obama, the U.S. Department of Labor recently issued final rules adjusting the minimum wage salaried, exempt employees must make in order to not be eligible for overtime. These regulations affect virtually all employers across the United States, including churches and other faith-based organizations. While there are exceptions, most employers will find that virtually all employees will fall under the new minimum wage rules.

New Overtime Regulations Affect Business and Nonprofits Alike
On May 18, 2016, President Obama and Secretary Perez of the U. S. Department of Labor issued a final rule updating federal overtime regulations. The updated rules are expected to extend overtime pay protections to over 4 million workers. This long-anticipated move is part of the President's commitment to ensuring working Americans are better compensated fairly for their work.
Key Provisions of the Final Rule
The Final Rule focuses primarily on updating the salary and compensation levels needed for employees classified under the Executive, Administrative, or Professional worker exemption categories to remain exempt from overtime. Specifically, the Final Rule: (read more)

Healthcare Care Costs
On June 21, 2016 the U.S. House of Representatives passed the bipartisan "Small Business Health Care Relief Bill" (HR 5447) designed to give small businesses, including nonprofits greater flexibility with regards to providing health care for their employees. The bill now heads off to the Senate where it is expect to receive favorable attention since it appears to compliment a similar bill being championed there. (read more)

Electronic ACA Information Returns Can Continue to Be Filed After June 30, 2016
The IRS has announced that although the June 30, 2016 deadline for filing information returns with the IRS has passed, the ACA Information Returns (AIR) system will remain up and running after the deadline to allow applicable large employers, self-insured employers and other health coverage providers to electronically file Forms 1094-B, 1095-B, 1094-C and 1095-C. This means filers who were not able to submit all required information returns by the June 30 deadline may still complete the filing electronically with the IRS. The IRS said it is aware that some mandatory filers are still in the process of completing their 2015 tax year filings. (read more)

Reimbursement Claims
Recently the question was asked as to whether or not an organization operating in California can have a policy that precludes reimbursing employees' expense claims not turned in within a mandated time frame.
While the law may differ from state to state, in California the labor code is very specific on this issue. Section 2802 states: "An employer shall indemnify his or her employee for all necessary expenditures or losses incurred by the employee in direct consequence of the discharge of his or her duties..." Mandatory Nevada Poster Updates
Effective July 1, 2016,
Nevada employers are required to post updated posters reflecting changes issued by the Office of the Nevada Labor Commissioner. Even if you purchased a 2016 Nevada poster, this update will require a new poster to remain in compliance.
