BRINGING THE BOE TO THE OCBOE
Our hearing was held in the Irvine City Council Chambers and we thank Mayor Steven Choi, the City council, staff and City Manager for their cooperation and use of their chamber.

It's always a good idea to have state officials and staff spend time with taxpayers across the state. Southern California represents two-thirds of the state population and provides the state with the bulk of tax revenue, jobs and economic growth. Having served in  the Legislature for six years, I saw first-hand how decisions with statewide implications are made with a San Francisco/Northern California focus. The goal of meeting in Irvine was to give our Northern contingent a better understanding of the unique needs, interests, economy, and character of Southern California.

My good friend and community leader, Commandant Pete Hammer, led the Pledge of Allegiance at the hearing. Pete is the c ommandant of the Marine Corps League-South Coast Detachment. We worked together in revitalizing the Dana Point 5th Marine Regiment Support Group in 2007. The group provides countless hours and dollars in support and outreach to wounded military personnel, families of the fallen, active duty Marines, and their families. YOUR MONEYMONEY
This month we heard an item requesting relief of interest in the amount of $324,852 for a case that we ruled in the taxpayer's favor on June 24, 2015. The facts of the case were as follows: (a) the taxpayer was audited for the period of April 30, 2002, through March 31, 2005; (b) the taxpayer, a small business owner, had been reporting his taxes on a cash basis; and (c) the BOE auditor changed the accounting method to accrual as appropriate, and in accordance with the statute as approved by the Legislature.CASH

However, a switch from cash to accrual accounting is not without consequences, and the taxpayer owed roughly $477,000 in taxes for the audit period. A subsequently contiguous audit was performed from April 1, 2005, through March 31, 2008, which (due again to the accounting shift) showed the taxpayer had overpaid by $470,000 for that audit period. In short, the audits somewhat cancelled each other out and the taxpayer had only underpaid taxes by $7,000! 

Unfortunately, the audit results were not consolidated, and the taxpayer was assessed $324,852 in interest for the initial audit. While the assessment was legal, the Board asserted that: (a) the taxpayer was not trying to avoid taxes as he had paid all but $7,000; (b) the two audits and results might have been more representative if consolidated; and (c) some adjustment should be made. 

Ultimately the Board concluded that relief of interest from July 11, 2006 through May 27, 2011 was warranted.  Accordingly, the Board ordered relief of interest in the amount of $211,084.96.

We were all deeply saddened by the announcement of the death of Senator Sharon Runner, wife of our Board Member, George Runner, on July 14th. As expected, Member Runner and his staff were unable to attend the hearing in Irvine, and we adjourned in memory of his wife. The Honorable Marian Bergeson
With the sad news of the passing of Marian Bergeson, it was my pleasure to adjourn the July Board hearing in her honor.

Marian was the kind of person we should all strive to be: intelligent, kind, and devoted. She exemplified honor, courage, and grace under pressure.

Marian lived life to the fullest and even celebrated her 83rd birthday skydiving. She will be remembered as the first female to serve in both the Assembly and Senate, and for her years of service to the state as the Secretary of Education and to the people of Orange County as a Supervisor. She will be missed and California is a better place thanks to her lifetime of service.

ENERGY: CAP AND TRADE SET TO EXPIRE?ENERGY
I remain a strong supporter of our manufacturing sector, and am always concerned about the high costs that many firms incur by way of regulation. Cap and trade is just one example of more money leaving the private sector for government use. The program today is in jeopardy, and may end by 2020. 
 
The four-year-old program is set to expire in 2020, and a number of  parties are scrambling to extend or curtail the program. Administered by the Air Resources Board (ARB), the California Global Warming Solutions Act of 2006 (AB 32) requires the state to curb greenhouse gas emissions to 1990 levels by 2020. The legislation authorized the state to use market based mechanisms to achieve emission targets, with cap and trade being the solution. However, the legislation cites 2020 as the expiration date for the program. In response to this looming deadline, ARB has released new draft amendments recommending a program extension to 2030.
