Member Kelly C. Morgan (left) and Associate Betsy L. Stewart (right) obtained a favorable ruling for the West Virginia Department of Health & Human Resources before the West Virginia Supreme Court of Appeals. Plaintiff sued over her inclusion as a "substantiated child abuser" in the Families and Children Tracking System and as a result of WVDHHR reporting a substantiation of abuse. Plaintiff alleged that she has suffered multiple job losses, has been denied State and Federal benefits, and has been branded an abusive and/or neglectful parent. The Circuit Court of Kanawha County granted a motion to dismiss for failure to provide mandatory pre-suit notice. The West Virginia Supreme Court affirmed that decision.
