This month, we are discussing legal issues related to secondhand smoke in common interest developments.  Secondhand smoke complaints are on the rise and many associations are developing policies for handling these complaints.  This topic has become a major conflict faced by community managers and board members.   It appears that courts in California are inclined to protect associations that regulate smoking.  While the law in this area is still emerging, we are sharing some starting points for your community to consider regarding smoking regulations and enforcement of secondhand smoke violations.
