Failure to Follow Showing Instructions is a Violation of the Code of Ethics
  opening_white_car_door.jpg Everyone gets in a hurry, needs to show a property on the fly because the clients are in the car, and the "blue box" is hanging on the front door.  "Surely it's OK if we just go!" No, isn't unless the owner/listing agent's showing instructions indicate that you can show without an appointment or notice.  The SELLER is in charge of how his/her property is accessed even when vacant. 

Failure to take the time necessary to read the showing instructions and follow them might result in a charge of violating Article 3 of the REALTOR® Code of Ethics as demonstrated in Standard of Practice 3-9: REALTORS® shall not provide access to listed property on terms other than those established by the owner or the listing broker. 

 
How Procuring Cause is Determined
If two brokers are unable to work out a commission dispute between themselves, the ONLY people that determine which Broker was procuring cause is an Arbitration Hearing Panel. man_dollar_hide.jpg














Commission disputes generally occur when two Selling Agents show the same property and the second agent makes the sale and takes the buyers to closing.  The first agent may feel he/she is procuring cause and entitled to commission. 

The definition of procuring cause is: The Broker/agent who STARTED the UNINTERRUPED series of events that, without a break in the chain, resulted in a successful closing.
