News from PREP Chapters

CENTRAL TEXAS PREP:

The Central Texas PREP Chapter met on April 22, 2014. The meeting began with a session about title plants, their value, their use of recorder's or clerk's information, and homeowners and underwriters use of title plants. The next session was given by the Texas Land and Title Association who gave an update on upcoming changes in the mortgage industry. Following these sessions, there was a discussion on legislative issues of joint interest such as correcting deeds and bulk data sales. The final session given by Jay Beitel of Polunsky, Beitel, and Green Attorneys at Law Group was regarding the new qualifications for mortgages that have already taken effect, including changes to the debt to income ratio and changes in verification requirements. The next PREP Chapter Meeting for the Central Texas Chapter will be held in conjunction with the Texas Association of Counties Pre-Legislative Conference at the end of August. PRIA Annual Conference - August 25-28 in Long Beach, CA

CSC's eRecording All-Star Awards
  
Corporation Service Company� (CSC�), a nationwide provider of paper and electronic real estate document recording services, is calling for nominations for its second-annual eRecording All-Star Awards.

For the first time, the awards will recognize both clerks/recorders AND document submitters who have implemented and promoted the use of electronic document recording technology. There are eight award categories this year: four for submitters and four for clerks/recorders. 

 

There is no fee to enter, and recording offices and document submitters may nominate themselves by completing this nomination form. The nomination deadline is noon Eastern Time on Wednesday, July 23, 2014.

A committee of CSC document recording management and operations staff will select the award winners. CSC will announce the winners in mid-August. Winners will receive a personalized gift to commemorate their achievements.

ALTA NEWS:  House Financial Services Committee Approves HR 4383 (by Michelle Korsmo, ALTA CEO)

On June 10th, the House Financial Services Committee (HFSC) unanimously approved HR 4383, the Bureau of Consumer Financial Protection Small Business Advisory Board Act. This bill has been a great vehicle for ALTA to raise awareness about how the CFPB is affecting the small businesses that make up the majority of the title and settlement industry. While it is not likely that this bill will make it into law this year, we are hopeful that HR 4383 provides us with a good launching pad for the next Congress. We sent this letter to Rep. Jeb Hensarling (R-Texas), chair of the HFSC, and Rep. Maxine Waters (D-CA), the committee's ranking member, encouraging the committee to pass HR 4383.

 

This bipartisan bill would establish an advisory board representing small businesses at the Bureau similar to the Consumer, Community Bank, Credit Union and Academic Research Advisory boards. Possible members of this advisory board might include title professionals, loan officers, mortgage bankers, realtors and data collection experts. This board would allow for more formal outreach to small business interests throughout the regulatory and supervisory process in contrast to the "one shot" small business review panels that occur only during the rule-making process.

 

Thanks to the efforts of attendees of the Federal Conference & Lobby Day in May, this bill had 35 bipartisan co-sponsors. We truly appreciate their recognition of the need for a strong and constant voice at the Bureau to discuss small-business issues. eRecording in Greene County, WI now available through Simplifile

Electronic recording in Green County, Wis., is now available through Simplifile.

"With eRecording, the document is right in front of us. We enter a few items and accept the document - no mail and no postage," said Green County Register of Deeds Cindi Meudt.  "If there is something that is incomplete, we would reject the document and within minutes it could be corrected and recorded." Other benefits of eRecording include fewer rejections, increased document security, and less overall paper waste.

 

"Our experience with Simplifile has been great. I certainly would like to see 25 percent of the documents eRecorded and a larger percentage in the coming years," Meudt said.

 

Green County joins 39 other Wisconsin counties, more than half the state's recording jurisdictions, in making Simplifile's eRecording service available to customers. (Read complete article.)
