 ILLINOIS TRUCKING THIS WEEK

April 11, 2014

ILLINOIS STATE LEGISLATIVE REPORT

Today is the Illinois General Assembly's deadline for passing bills from the first chamber. Lawmakers will now be on a 2-week Spring Break before returning to Springfield when the Senate will debate House bills and the House will debate Senate bills.  The 2014 Session wraps up May 31.

The Illinois Trucking Association has been actively involved in the legislative process again this year, representing the trucking industry at the Capitol. Several trucking-related bills passed the Senate this week.

Speed Limit Differentials - In January, the Illinois Trucking Association requested that IDOT reduce car speed limits in the Chicago-area where they had created a 15 MPH differential between cars and trucks: Cars at 70 MPH and trucks at 55 MPH.

Illinois Trucking Association

The department denied the association's request, so the Illinois Trucking Association was forced to initiate legislation that would raise truck speed limits from 55 to 60 MPH on those rural interstates just to reduce the speed differential back to a 10 MPH difference.  SB930, sponsored by Sen. Martin Sandoval (D-Chicago), passed the Illinois Senate on Wednesday by a vote of 58-0. The bill now moves on to the House where it will be sponsored by Rep. Martin Moylan (D-Des Plaines).

2,000-lb Weight Variance for NG Trucks - Legislation initiated by the ITA that would grant a 2,000-pound weight variance for trucks powered by Natural Gas passed the Illinois Senate on Wednesday. SB 3574, sponsored by Sen. Martin Sandoval passed the Senate by a vote of 58-0. If the bill is passed by the House and signed by the governor, trucks that are powered by natural gas would receive additional weight limitation of 2,000-pounds on all roads except for federal interstate highways.

The weight variance is needed to compensate for heavier fuel tanks that hold CNG or LNG. SB 3574 now moves on to the House where it is sponsored by Rep. Rita Mayfield (D-Waukegan).

Truck Towing Restrictions - Another bill initiated by the Illinois Trucking Association passed the Illinois Senate on Tuesday. SB 2932 would prohibit the practice of towing companies removing semis from an unauthorized lot by driving the vehicle away under its own power. Several ITA members have had their trucks "towed" by companies that quickly remove the semi, drive it to their impound lot, and then demand thousands of dollars in towing and storage fees.

SB 2932, sponsored by Sen. John Sullivan (D-Rushville), passed the State Senate on Tuesday by a vote of 55-0. The bill now moves on to the House where it will be sponsored by Rep. Dan Beiser (D-Alton).

ATA STATE LAWS NEWSLETTER

The following is courtesy of Bob Pitcher, American Trucking Associations

MN Repeals Warehouse Sales Tax - By legislation (HF 2395/SF 2107) signed into law by Governor Dayton on March 21, 2014, Minnesota has repealed a sales tax imposed on warehousing and storage services.  The tax was imposed by legislation enacted in 2013, but not effective until April 1 this year.  So the new levy never went into effect.  The repeal of this burdensome tax was one of the top priorities of the Minnesota Trucking Association this legislative session.  Our congratulations to the association and its president, John Hausladen!

MS Passes Sales Tax Exemption for Rolling Stock - Currently, Mississippi charges a sales tax of 3 percent on the purchase of rolling stock by interstate motor carriers, apportioned by the mileage traveled in Mississippi by the fleet of which the new vehicle is a part.  By legislation (S.B. 2934) passed by both houses of the legislature, Mississippi will, as of July 1 this year, exempt tractors registered under the International Registration Plan and semitrailers used with such tractors. The Mississippi Trucking Association expects the governor to sign the bill shortly.  Our congratulations to MTA and its president, David Roberts!

OR Court Holds Fee Increases Illegal - The Oregon Trucking Associations reports that a circuit court in that state has upheld a challenge brought by the association and others to a recent large increase in the fee charged by the state department of transportation for drivers' records.  Until 2010, the state DOT charged $2 per record for the 2 million or so records obtained annually by third parties, mostly prospective employers and insurers.  At that point, however, the state raised the price to $9.68, with some of the new money dedicated to building new websites for several state agencies.  OTA and others sued on the basis of the Oregon constitution's strong provision reserving the proceeds of highway-related fees to highway purposes.  And on March 14 this year, at the conclusion of the state's presentation of its case, a Marion County Circuit Court judge ruled unexpectedly from the bench that the state's scheme was illegal.  A written opinion from the court should follow shortly.  For more information, contact OTA's Debra Dunn at 503-513-0005 or [email protected].

ATA's NAFC Meeting Coming Up in June - Registration is now open for the joint meeting of two ATA councils, the National Accounting & Finance Council and the Information Technology & Logistics Council, to be held this year June 16 to 18 at the Lincolnshire Marriott Resort in the northern suburbs of Chicago.  The NAFC is ATA's individual membership organization for accountants, insurers, finance and tax experts serving the trucking industry, both in-house with motor carriers and with third-party suppliers.  The NAFC sessions at the meeting will include updates on independent contractor issues, accounting developments, captive insurance companies, and state tax developments (the last presented by this writer).  Attendees can also go to any of the ITLC sessions as well.  For more information, or to register for the meeting, go here:
