4 Common Small Business Mistakes That Lead to Employee Lawsuits 

Did you know almost 75 percent of all litigation against corporations today involves employment disputes? Over 40 percent of these lawsuits are filed against smaller employers (15 - 100 employees).

 

Employment-related lawsuits are often even more costly for small businesses than consumer lawsuits. The median compensatory award for employment practices liability insurance cases is $218,000. The precautions you take today can prevent a frivolous--and potentially bankrupting--court case tomorrow. Here are four mistakes that can get you into trouble.

 

 

1. Not Running Background Checks on Employees
A first impression is always important, but it's hardly the only thing on which a job candidate should be judged. Considering the cost of employment-related lawsuits, your small business should do a thorough background check on prospective hires. 

 

2. Using or not Using Employment Agreements At the Wrong Times
Connecticut is an "at will" state, so that an employment agreement, unless carefully drafted, can create rights for the employee that otherwise they are not allowed under the law as an at will employee. However there are times with certain key employees or particular situations that you may want a written employment agreement. In that context, written employment agreements, as long as they are professionally drafted, can eliminate any doubts about what is expected in the employee/employer relationship. However, if they are poorly drafted they may create rights for the employee that you never intended to provide. Please be careful in this regard.

 

3. Inadequately Documenting Terminations
Employees will come and go even if you have excellent advancement opportunities and work hard to reduce employee turnover. Terminations are part of running a small business, so you must carefully plan for them. If an employee is warned or discipline, keep a written memo of the warning or discipline and if possible have the employee sign the memo that they are aware of this violation. You need to keep meticulous records on wrongdoing by an employee to be used if they ever bring a wrongful termination claim or the employer wants to challenge the unemployment claim being pursued.

 

4. Ignoring Relevant Employment Laws
Failure to follow basic, relevant employment laws could be much worse than just a lawsuit. You could face fines and even lose your license. Federal and state employment laws are nothing to ignore; make sure you thoroughly understand and comply with all of them. 


Improving human resources management in your small business is critical in many ways. Adhering to all necessary policies, procedures, and laws enables you to reduce your risk for lawsuits, whether coming from employees or other businesses. Lawyer who clicked on attachment loses $289K in hacker scam 

 

 

 

A lawyer who clicked on an email attachment lost $289,000 to hackers who likely installed a virus that recorded his keystrokes.

 

The anonymous lawyer, identified only as John from the San Diego area, told ABC 10 News how it happened.

 

On Feb. 9, John received an email with an address ending in usps.gov. Thinking he had received a legitimate email from the U.S. Postal Service, he clicked on the attachment.

 

Hours later, John tried to access his law firm's account with Pacific Premier Bank, the story says. He was transferred to a page asking for his PIN, rather than his usual login, and received a call from a person identifying himself as a bank employee.

 

The caller said the bank noticed John was having trouble accessing the account and told him to type in his PIN, along with another number, which turned out to be a wire transfer code. Then a page appeared saying the site was down for maintenance.

 

John received another call from the supposed bank employee two days later. "He asked me to enter the information several times, but told me it wasn't working. He then said I was locked out of my account for 24 hours," John told ABC 10 News. "That's when alarm bells started to go off."

 

Within hours, John discovered that $289,000 had been transferred from the account to a Chinese bank.

 

"I never thought it would happen to me," said John. "I was shocked. I felt like a dummy, basically."

 

An expert who spoke with ABC 10 News said the hackers evidently installed a virus to capture John's keystrokes. Whether a bank will cover the loss depends on its terms and conditions, the expert said.

In John's case, Pacific Premier Bank declined to cover the loss.

 

So, what can you do to protect yourself. Keep your antivirus and anti-malware up to date. Secure your password and your network and most important do not open emails you are not 100% sure of the source. Check with your computer consultant expert and make sure all precautions have been taken for your server and data.
