HIPPAHIPAA Rule Change Part of Move to Fight Gun Violence

Only a few healthcare organizations report to the federal database that conducts background searches on people who want to buy guns, but those groups will get a little more latitude through a final HHS rule that's part of a White House package announced this week aimed at combating gun violence.

A change to the Health Insurance Portability and Accountability Act clarifies who can share data with the FBI's National Instant Criminal Background Check System (NICS). HHS says the rule change will facilitate the flow of information from providers to NICS.

The database was created to prevent guns from being sold to prohibited individuals, including felons, but also persons found to be "mentally defective" or who have been involuntarily committed to a mental institution.

The U.S. Justice Department credits NICS with preventing more than 2 million guns from getting into the wrong hands since it was created in 1998.

Will Delay Weaken CDC Opioid Guidance?

- Recommendations to limit supply and dosing under fire

Although the CDC's pending guidance on opioid prescribing -- expected to be some of the strongest federal advice on opioids to date -- was supposed to drop this month, politics have forced the agency into an additional public comment period.

That has some experts wondering whether strong advice about supply and dosing limits will be preserved.

10 Biggest Challenges to ASC Profitability in 2016

Ensuring ASC profitability in 2016 will require more out-of-the-box thinking than ever before due to declining reimbursements and the further fee-for-performance integration into care delivery.
"2016 is likely to bring further shifts towards value-based purchasing for ASCs," says Brian Mathis, senior vice president, strategy and payment innovation at Surgical Care Affiliates. "We have seen this take on many forms ranging from quality incentives for surgeons to bundled payments to full capitation. ASCs provide high quality care at lower cost so are well positioned to capitalize on this shift to value."

It is important that ASCs leverage their unique position to succeed in the new value-based landscape.

Here are some of the biggest challenges to ASC profitability in the coming year and how to overcome them:

Kypho32 Hospitals Will Pay $28 Million to Resolve Kyphoplasty Probe

Thirty-two more hospitals have agreed to pay $28 million to settle allegations that they billed Medicare for kyphoplasty procedures as inpatient rather than outpatient services to make more money, the U.S. Justice Department announced Friday.

The settlements are the latest in a long-running whistle-blower lawsuit that alleged equipment-maker Kyphon encouraged hospitals to perform the procedures on an inpatient rather than outpatient basis to help pay for kits used in the procedures and pull in more cash for hospitals. In all, more than 130 hospitals across the country have now settled in the case.

The hospitals in this latest round of settlements span 15 states. They include, among others, the Cleveland Clinic, which will pay $1.74 million; five hospitals affiliated with Community Health Systems, which will pay $3.5 million; five hospitals affiliated with Tenet Healthcare Corp., which will pay $2.2 million, and five hospitals formerly owned and operated by Health Management Associates, which will pay $2 million

MUMeaningful Use Program 'Effectively Over,' Says CMS Head

MU will be "replaced with something better," says Andy Slavitt. Reaction from healthcare CIOs is largely one of relief.

For the first time, the leader of the Centers for Medicare & Medicaid Services has said publicly that the agency "has the opportunity" to sunset the meaningful use program in 2016.

Andy Slavitt, acting administrator of CMS, made his remarks Tuesday at the J.P. Morgan Healthcare Conference in San Francisco. Slavitt's full remarks were then posted on the CMS blog, and summarized in a series of tweets.
