Update from Tenzer PLLC's Litigation/Arbitration Practice Group

As part of this firm's commitment to keeping our clients up-to-date on important developments in the law, the firm's litigation/arbitration practice group continues to monitor a number of pending Supreme Court cases particularly relevant to our clients in the telecommunications and hospitality industries.

In the wake of Justice Scalia's unexpected passing, an eight-member Supreme Court creates a strong probability that a number of highly anticipated rulings will result in a 4-4 split decision, which results in affirmance of the lower appellate court's opinion and no precedential value.  One such case, Spokeo v. Robins, is particularly likely to be affected by Justice Scalia's absence.  In Spokeo, the Court is considering whether plaintiff's lawyers can sue on behalf of consumers who have no actual monetary damages but may be entitled to statutory damages.  A determination that consumers need actual damages to bring these types of actions would have implications for many state and federal consumer protections statutes under which plaintiffs frequently sue, individually or on behalf of a class, alleging a only a technical violation of the law.

A 4-4 decision in Spokeo would be a victory for the plaintiff's bar. Please contact us to further discuss any of the cases pending on the Supreme Court docket, or how a potential split decision may affect your business.
