The tefilla of Havineinu
If someone is in a situation where he cannot stand up for an uninterrupted tefilla, he should wait to daven later if the situation is expected to improve before the end of zman tefilla. However, if he does not expect the situation to improve by that time and meanwhile is unable to daven even sitting or walking, or if it is too close to the end of zman tefilla to recite the entire Shemoneh Esrei, or if he is sick and cannot recite a long prayer, he is permitted to daven an abridged Shemoneh Esrei known as Havineinu. Havineinu begins and concludes with the standard three first and last berachos of Shemoneh Esrei, and between them contains one short beracha comprised of essential words from each of the standard thirteen middle berachos.

When Havineinu may not be recited
Havineinu cannot be recited during the winter months when v'sein tal umatar must be included. It should not be recited on motzei Shabbos when atah chonantanu (the paragraph of havdalah recited in Shemoneh Esrei) is added, but one is yotzei if he did recite it then. Someone who includes v'sein tal umatar or atah chonantanu in Havineinu probably does not fulfill his obligation. (If someone did not daven Ma'ariv on motzei Shabbos until close to morning and there is not enough time to recite the complete Shemoneh Esrei before dawn, he may recite Havineinu and omit atah chonantanu.) It is questionable if Havineinu can be recited on a ta'anis tzibur when aneinu is added, during the aseres yemei teshuva when hamelech hamishpot is inserted, or on Tisha B'av when nachem is included.

Other situations when Havineinu cannot be recited
Havineinu may not be recited at times when it is possible to daven the complete Shemoneh Esrei. The poskim debate whether one fulfills his obligation by reciting Havineinu at such times. Nowadays Havineinu should not be recited in situations where people are too distracted to daven the standard Shemoneh Esrei; since most people today don't have proper kavanah and we are distracted so often, we would end up never davening the full Shemoneh Esrei. Workers today should not daven Havineinu even if they are supposed to be paid only for time spent working, because it is standard for all workers to take time for davening. They should not take the time to go to shul without the consent of the boss, however.

  • Someone who cannot wait until after kedusha, etc., to begin davening may daven along with the chazan as he recites his repetition. When the chazan reaches kedusha, the person should join him in reciting the entire kedusha including l'dor vador (according to nusach Ashkenaz, and Atah Kodosh in nusach Sfard).
  • An individual davening along with the Chazan should not recite the kedusha d'sidra or kedusha d'yotzer with the tzibur.
  • Ideally, someone davening along with the Chazan should recite each word together with the chazan and not read ahead.  He will thus be able to reach Shomea Tefilla and Modim together with the chazan.
