Bills that Threaten Your  Access to Justice

The victims of asbestos exposure and their families have been through so much, it is hard to believe that asbestos companies are working to further restrict their access to justice.   Several bills have been introduced to legislators aiming to delay and deny compensation to victims, as well as put their privacy at risk:

Furthering Asbestos Claims Transparency Act
The so-called "FACT Act" will delay and deny compensation to the victims of asbestos-related diseases. If passed into law, asbestos victims will be required to publish their private medical, work, and personal histories, including the last four digits of their social security numbers. 

Several states have introduced their own version of the so-called FACT Act:

Transparency in Private Attorney Contracts 
Act
The families of asbestos exposure victims in South Carolina are urging legislators to "stand with the families affected, and not make special protections for the companies that were responsible for exposing people to asbestos."

Asbestos Litigation Transparency Act
In Utah, the Asbestos Litigation Transparency Act (H.B. 403) is opposed by workers, veterans, and their families. The House Business and Labor Committee of Salt Lake City has voted 7-3 to advance litigation of this bill. 
Johnson & Johnson to Pay $72 Million  for Cancer Death Related to Talcum Powder Use

Recently, a  jury in St. Louis awarded $72 million in damages  to the family of a woman who died of ovarian cancer in 2015. Her cancer was determined to have been caused by her Johnson & Johnson brand talcum powder use. The company is currently facing pending lawsuits from approximately 1,200 more plaintiffs.
