A Note From Our President

Dear Members,

As President of the Association, I am committed to represent all Members, regardless of size or scope of operations.  My door is always open to hear from you on issues concerning our industry. With this, my interest in growing the membership is key to the success of our mission as an Association.  The more people involved and focused on our mission, the more we can achieve.  

To that point, I am involved in other industry Associations and peer groups.  Recently, at UMA's event in Washington, D.C., two hot topics were the Safety Fitness Determination (SFD) and Lease Interchange language being proposed by the FMCSA.  

I just received the good news that the bill scheduled to be marked up in Subcommittee and concerns with the Lease Interchange Rule will be addressed in the Committee's report language.

SFD:  "The SFD language is exactly what UMA asked for, that being a directive that the FMCSA cannot use any funds to amend the regulations relating to safety fitness determinations for motor carriers until ALL reforms to the Compliance, Safety and Accountability (CSA) programs mandated by the FAST Act are complete". 
 
Lease Interchange:  The Lease Interchange issue will be addressed in the House Committee Report, once that is filed next week.  The language will be identical or similar to that included in the Senate DOT Appropriations report as follows:  
   
"On March 16, 2016, FMCSA announced it was extending the compliance date for its final rule concerning the lease and interchange of passenger carrying motor vehicles [Docket No. FMCSA-2013-0103j], based on issues raised in numerous petitions for reconsideration. The Committee is pleased by this action, and directs FMCSA to expeditiously complete its review and modify the rule to resolve the issues raised, and ensure the rule appropriately targets unsafe passenger carriers without unduly interfering in compliant business operations. The Committee is confident FMCSA can resolve all outstanding issues prior to January 2018; however, if it is unable to effect a modification of the rule within this time period, the Committee expects FMCSA to grant an additional extension, until the rule can be modified."
 
UMA has pushed for language to direct an earlier resolution date than January of 2018 and both Committees believe the agency will move to answer the petition for reconsideration before the end of the calendar year, as your operations are still exposed to liability with the rule in place.

CVSA's Roadcheck Alert

CVSA's 29th annual International Roadcheck will take place  June 7-9, 2016

The CVSA's Roadcheck is a 3-day/72-hour period when approximately 10,000 CVSA-certified local, state, provincial, territorial and federal inspectors in jurisdictions across North America perform large truck and bus safety inspections.
During the annual event, CVSA-certified inspectors conduct compliance, enforcement and educational initiatives targeted at various elements of motor carrier, vehicle and driver safety.
The special emphasis for 2016 International Roadcheck is tire safety. Inspectors focus on:
  • Tire tread depth  
  • Tire pressure
  • Overall condition of the tire 
  • No items are lodged between dual tires  
  • No deep cuts or bulges exist in the sidewalls of the tire
While checking a vehicle's tires is always part of roadside inspections, CVSA is highlighting tire safety as a reminder to drivers and carriers.

Inspectors will primarily be conducting Level I Inspections, a 37-step procedure that includes an examination of both the driver and vehicle.
Drivers are required to provide items such as their license, endorsements, medical card and hours-of-service documentation, seat belt usage and the use of alcohol and/or drugs.
