Port of Oakland PLA
On May 4, 1999, the Port of Oakland Commissioners (the Board) authorized the negotiation of a Project Labor Agreement and the retention of a Project Contractor and Legal Consultant to conduct the negotiations.  On May 15, 2000, Davillier-Sloan, Inc./ Parsons Constructors, Inc.  (DSI/PCI), on behalf of the Port, entered into a comprehensive Project Labor Agreement, known today as the Maritime and Aviation Project Labor Agreement (MAPLA). This discriminatory "agreement" is now reaching its end of life but the Port Commissioners have decided that continuing to discriminate against workers, contractors, and apprentices is a good thing.
 
The board will be presented with a revised PLA soon. Stay tuned. 
East Bay Municipal Utility District
The long drawn out PLA being considered for the Chabot Dam Seismic Retrofit project just got real interesting. Staff and the Building Trades have come to a stalemate on the PLA proposed by the district over the following three points in EBMUD's proposed PLA:
  • Targeted/Local Hiring - Staff developed its own district-wide program independent of the PLA; the Building Trades used the example of the City of Oakland local hire program under the PLA for the Army Base project where the local hire increased to over 50% from high 30s without a PLA as the argument that local hire is increased under a PLA
  • Equitable Participation for all Contractors - Contractors are able to provide existing benefits to their employees (The Alameda Building Trades will not budge on this one)
    • Staff even presented a slide to illustrate what happens to benefits for the union and non-union contractors with and w/o a PLA
  • Efficient and Effective Performance of the Work - contractors can use six of their core workforce (staff cited County of Santa Barbara PLA as example)
Staff reviewed the survey of 11 contractors:
3 signatory contractors to four or more trades
5 signatory contractors to three or less trades
3 non-union contractors
 
7 indicated a disincentive to bid
11 indicated PLAs increase the price
 
Staff Summary:  PLAs adversely impact non-union contractors and limits competition.

30% of EBMUD's contractors are non-union.
 
The design schedule has been delayed slightly since the May 12, 2015 update.  The project is getting to the critical point in the timeline where the PLA negotiations need to be completed by November for bid advertisement in December.
 
The PLA item is going to be a standing item on the legislative committee agenda until the PLA negotiations are finished.
School Bond PLA Update
Santa Clara USD: September 24th board meeting discussion regarding the legality of having union employee and PLA advocate Chris Stampolis vote on any PLA the board might consider in the future.
 
Salinas USD: The school board appears tired of trying to have staff negotiate a PLA with local union bosses that have some fair elements in it. They have now called for an emergency meeting on Tuesday, September 29th to apparently hand the unions everything they want. We need bodies at this meeting. Please contact CFEC today is you are able to attend this meeting in Monterey County.
 
Fremont USD: PLA will be discussed at the Bond Oversight Committee on October 7. We need contractors to attend this meeting. Please contact CFEC if you are able to help.
Imperial County PLA
The $30 million Imperial County Jail Expansion Project is moving ahead with a PLA despite our discussions with three of the five Supervisors who promised CFEC they would "take action" to stop the PLA until it had been properly discussed. We need you to contact the Board of Supervisors TODAY and let them know you oppose PLAs and that they need to have a full discussion on this issue before it is shoved through and approved.
