NEW: Information on House Bill 1477
House Bill 1477 was introduced on August 10, 2015.  This bill is a direct attempt to undo recent changes (Act 6 of 2011 and/or Act 60 of 2012) to the PA Unemployment Compensation (UC) Law.  The full bill and the Co-Sponsorship Memoranda explaining the bill can be found HERE.

The Senate Labor & Industry committee held a meeting in Erie, PA on August 5th regarding the effects Act 60 had on "seasonal workers."  I provided testimony indicating that since the PA UC Fund is in debt to the tune of over $2 billion, that there should be no rollback of the changes that started the Fund on the road to solvency.  The PA Chamber of Business & Industry and the National Federation of Independent Business also provided similar testimony.  It appears the Senate will hold another hearing in September in the Philadelphia area on this topic.  That being said, the House has introduced this bill.

HB 1477 provides for the following.
  • Changes definition of the base year (often referred to as the "look back period") to four of the last six calendar quarters immediately preceding the first day of an individual's benefit year.  It provides no explanation as to which 4 quarters would be used, but you can rest assured the purpose of this would be to let the employee pick the 4 quarters which would entitle them to the most in benefits.  
  • Please note that the "base year" definition was not changed in 2011 or 2012.  Thus, this is an attempt to increase eligibility further from a standard that has been set for as long as anyone can remember.
  • Also note, that since this would increase the "look back period," this will increase your potential cost.  This is especially true for all public educational institutions, counties, boroughs, townships and non-profit corporations. 
  • Reduces the amount necessary to earn a credit week from about $116 to $100, again making it easier for one to qualify financially for benefits.
  • Creates a new section of Law requiring employers to withhold one cent ($.01) per hour worked from each employee and to submit that withholding to L&I.  This withholding tax is in addition to the current .0007 that employers are currently required to withhold from gross wages.
  • What type of accounting nightmare would this cause?
  • How much would it cost to redo your programming for payroll?
  • Reduces the requirement that 49.5% of their total wage in the base year be earned outside of their high quarter of wages to 28%.  Prior to Act 60, this figure was set at 20%. 
  • Please note that it was this change (20% to 49.5%) which was the main factor in this movement to undue the provisions of Act 60. 
  • Removes the requirement that one must earn 6 times their weekly benefit rate in "covered employment" in order to purge a disqualification.  This means that they want to permit someone who is disqualified for benefits to then be paid for painting his/her brother's house and become eligible for benefits after that "job" is completed.  All that is required is a note from the payee for these alleged services.
  • Increases the step down provisions used in determining an individual's weekly benefit rate from 2 to 4 steps.  Prior to Act 60, there was only a 3 step provision.
No fiscal study has been conducted by the General Assembly and/or the PA Department of Labor & Industry as the bill has just been introduced.  Please note that these changes are being pushed for by the PA State Building & Construction Trades Council, the PA AFL-CIO, as well as other representatives of labor.  Thus, we (Geoffrey D. Moomaw, President, Interstate Tax Service, Inc.)  recommend that you take this bill seriously.  We (Geoffrey D. Moomaw, President, Interstate Tax Service, Inc.) recommend that you contact your state representative and senator to alert them of your opposition to House Bill 1477.
