Appellate Division Says No to Protecting Supplier List from Disclosure

On December 4, 2015, the New Jersey Appellate Division rejected a retailer's request to afford its supplier list trade secret protection in Samsung Electronics America, Inc. v. Westpark Electronics, LLC, Docket No. A-3777-14T3. While the court did not go so far as to suggest that a supplier list may never attain trade secret protection, the decision continues the trend of New Jersey courts refusing to go down that path, as no New Jersey court has ever expressly provided protection to a supplier list as a trade secret...

Joint Federal-State Effort to Increase Minimum Wage to $15 Per Hour Announced
New Jersey races to be the first state to pass $15 minimum wage rate
On February 9, Senate President Stephen Sweeney and Majority Leader Louis Greenwald announced the introduction of another Constitutional Amendment to increase the minimum wage, this time to $15.00 per hour.
In November 2013, New Jersey voters approved a constitutional amendment that increased the minimum wage to $8.25, with future annual increases tied to the Consumer Price Index. The current minimum wage rate is $8.38 per hour.
Under the Sweeney/Greenwald proposal, New Jersey's minimum wage would increase to $9.00 per hour effective January 1 of the year following the amendment's approval by voters, after which it would increase by $1.00 per year for the next six years, until it reaches $15.00 per hour. If both houses of the Legislature pass the proposed Constitutional Amendment by a 3/5 majority by August 30, 2016, the measure would be placed on the November 8, 2016 ballot.
The announcement was made in collaboration with the introduction of Congressman Norcross' Fair Wage Act of 2016, in which he proposes to increase the federal minimum wage from $7.25 per hour to $15 per hour by 2023 (the same year that New Jersey's minimum wage would reach $15.00 under the Sweeney/Greenwald proposed Constitutional Amendment). This announcement comes on the heels of last week's press conference during which Assembly Speaker Vincent Prieto also proposed to increase the minimum wage to $15.00 per hour, with no phase in. The Speaker's bill will also need to be passed by the Legislature, but by a simple majority, and would require the Governor's signature in order to become law. Whichever version of the $15.00 minimum wage increase passes, businesses face an 80% increase over the current minimum wage rate of $8.38...
