The Consumer Financial Protection Bureau (CFPB) has now assumed the primary rulemaking authority over the Fair Credit Reporting Act (FCRA).

Therefore effective January 1, 2013 the attached forms have been updated and must be utilized by ALL EMPLOYERS:

Notice to End-Users (this notice explains the employers responsibilities when using employment background checks)
FCRA “Summary of Rights” (this notice must be given to each applicant/employee who has a background check conducted on them)

Introduction from the Editor

In this edition of our monthly e-newsletter, we feature an article on dealing with inaccurate information on consumer credit reports. According to a 60 Minutes report, 40 million consumers in the United States have an error on their credit report (1 in 5 Americans) and 20 million have significant mistakes (1 in 10 Americans) on their credit report.

Our legal alert covers Senate Bill 377 in Ohio, which was implemented in September 2012. This bill will allow applicants residing in Ohio with past felony and misdemeanor convictions to apply to the court to lift the “collateral sanction” that bars them from being considered for employment in certain industries, including industries that specifically bar individuals with certain convictions.

Finally, our tip of the month explains the importance of applicant integrity surveys. Applicant Integrity Surveys are structured to pose questions (which have already been answered on the background screening report) to the applicant, allowing them to “come clean” regarding their past.
