missdignofsGovernor Signs MISS DIG Legislation Sponsored by Nofs

Governor Rick Snyder has recently signed legislation creating the MISS DIG Underground Facility Damage Prevention and Safety Act. Senate Bills 539 and 540, sponsored by state Senator Mike Nofs, update a 40-year-old state law designed to prevent damage to Michigan's valuable underground infrastructure.

"As more and more of our important infrastructure is placed underground, this needed legislation will better help Michiganders protect it and themselves from damage and danger," Snyder said.

SB 540 establishes the act. It requires excavators to call MISS DIG before digging underground and requires underground facility owners and operators to mark underground facilities so they can avoid being damaged by excavators. The bill provides civil and criminal penalties for violation of the act, including a general civil enforcement process and a specific process for local governments, both to be administered by the Michigan Public Service Commission. The bill also requires the commission to implement provisions for reporting and tracking damages to underground facilities, and to make the data publicly available on its website. The bill is now Public Act 174 of 2013.

The companion SB 539 updates existing law relating to penalties and liability for damage to underground facilities by governmental agencies. It is now PA 173. The new laws go into effect on April 1, 2014.

nsoelfGive Back - Join the NSO Holiday Elf Program

As the holidays approach, many of us are looking for ways to give back to those less fortunate, teach our children the true spirit of the season, or rally a group around a common cause.

The NSO Holiday Elf Program provides opportunities big and small for everyone to make a difference in the lives of our most vulnerable neighbors.

Neighborhood Service Organization (NSO) was established in 1955 as a private non-profit human service agency. The Mission of NSO is to provide diverse and innovative community development programs and community services to meet the changing needs of the region's population. Prevention and training are fundamental components of their programs. These components empower consumers and enhance the skills of other professionals.

Recently, NSO miraculously transformed the historic Michigan Bell Yellow Pages Building in Detroit into 155 apartment units of permanent supportive housing for the homeless.

As an NSO Elf you can choose to adopt a family, buy a gift for a Bell Resident, provide toys for a developmentally disabled person, keep the homeless warm, send a card to a forgotten senior or reward our youth for working to make a better life for themselves and their community.

safetytoolkitCAM Safety Tip: Gas-Powered, Hand-Held Cutoff Saws

Recently, an employee was injured while using a gas-powered, hand-held cutoff saw. The employee was wearing a face shield with safety glasses while conducting this work. The project involved cutting and capping an 8" cast iron in-ground fire water pipe. The pipe was almost cut to completion. When the employee inserted the saw to cut the final bottom portion of pipe the upper quadrant of the blade caught on the pipe. The sudden slowing or stopping of the blade caused by catching or binding in the upper quadrant
of the blade can cause the machine to be thrown upward and back toward the operator. The manufacturer calls this motion from reactive forces a "rotational kickback". It happens immediately, instantaneously and is uncontrollable. The rotational kickback in this instance caused the machine to flip back catching the employee under the face shield and in the chin area with the blade.

Lessons LearnedEmployers need to raise awareness of the potential for rotational kickback in these widely-used machines in the construction industry by reviewing the manufacturers safety manual with workers. To reduce the risk of rotational kickback avoid cutting with the upper quadrant of the wheel where possible. Properly rotate the guard to the proper position prior to cutting. Body position is critical when using this machine safely. Maintain good balance and footing and position the cut off machine in such a way that your body is clear of the cutting attachment should the machine

experience rotational kickback. Always wear a face shield when cutting.  Always choose the proper tool for the job-the proper tool is not always the "quickest."
