New Jersey's Ban the Box Law
Department of Labor's Final Regulations and Guidance, Effective Immediately
 
The New Jersey Department of Labor and Workforce Development issued its final regulations, effective immediately on December 7, 2015, clarifying the requirements of the state-wide ban-the-box law, also known as the Opportunity to Compete Act.  The regulations address some of the questions and gaps left open since the Act became effective less than a year ago, on March 1, 2015. 
  
The regulations clarify certain key aspects of the Act.  Specifically:
  • Employers of 15 or More Employees Are Covered
  • Use of Multi-State Forms Is Permitted
  • Internet Searches Are Prohibited:
  • DWI/DUI and Motor Vehicle Violation Records Are "Criminal Records"
  • Interns and Apprentices Are Protected By the Act
  • No Protection for Independent Contractors
  • Employee Leasing Agencies vs. Referral Agencies

Background Check Failed to Find Nanny's Record    

This Boston Globe article illustrates the need to conduct comprehensive background investigations. There is a best practice that should be followed when conducting a background check, especially when it involves the protection of minors.  
   
Stephanie Lee Fox was a notorious thief. She was convicted of dozens of larceny and fraud charges in Greater Boston, spent time in jail, and was still on probation when she registered as a nanny on Care.com.

Yet, the Waltham-based company that calls itself the world's largest Internet site for finding family care failed to detect Fox's lengthy, public criminal record during a background check - a service it explicitly promised to provide to a Boston couple seeking a caregiver for their two children, according to lawyers for Fox and the couple.

KinderMourn -- a nonprofit organization that has helped 14,000 families cop e with the loss of a child or loved one through individual counseling, support group s, and more -- has a personal connection to CSI's Senior Director of Regu latory Operations, Peter Fowler. He speaks to various groups on behalf of KinderMourn as a way to raise awareness and support for the agency which helped him in his own time of personal crisis. This holiday season, the CSI Chapin Office donated food and snacks to KinderMourn to assist bereaved parents and children. These items were put to good use within the children's program during the holiday season and beyond.
