Article 15 of the Code of Ethics prohibits REALTORS® from making false or misleading statements about other real estate professionals, their businesses or their business practices (15- 2 & 3). Further, the obligation to refrain from making false or misleading statements includes the duty to not knowingly or recklessly publish, repeat, retransmit or republish false or misleading statements made by others. It also requires the duty to publish a clarification or remove statements made by others on electronic media the REALTOR® controls once the REALTOR® knows the statement is false or misleading. Social media has created a forum for individuals to share their feelings over the good, the bad and the ugly. REALTORS®, however, should use caution when naming names of other professionals in the heat of the moment. It could result in your receiving another type of communication: "You have been named as the Respondent in an ethics hearing alleging violation of Article 15 of the REALTOR® Code of Ethics." |
