The mother of a Nutter Fort (West Virginia) Firefighter has filed wrongful death lawsuit against five companies involved in working on two cell towers that collapsed killing two employees, as well as her Firefighter son (in the Line of Duty) when he tried to help.

 

The lawsuit also names the Summit Park Volunteer Fire Department and its former chief, Brenda Fragmin, as defendants*. The lawsuit cites the NIOSH investigation HERE:

....that "identified an ineffective incident command on the part of Defendant Summit Park and Defendant Fragmin as one of the contributing factors."Garrett was killed when a second tower collapsed and part of it struck him after Fragmin had told him and other Nutter Fort volunteer firefighters to remove a worker who had been injured when the first, larger tower had fallen, the lawsuit asserts.

==OKLAHOMA FIREFIGHTER LODD DETAILS & MEMORIAL INFORMATION:

Following last weekends Line of Duty Death of Fire Capt. Jason Farley, one of the firefighters who tried to save him was readmitted to the hospital.

 

Lt. Zane James had been released Monday in time to join the evening procession with Farley's family from Tulsa International Airport to outside Verdigris High School. He had been hospitalized early Sunday after floodwater pulled him into a drainage pipe and ejected him into a fence, Claremore Fire Chief Sean Douglas said.

 

Captain Farley, a 19-year veteran of the department, lost his life after rescuing Shannon Roberts and six small children from a duplex, which flooded during a fifth birthday sleepover party for Roberts' daughter.

 

Captain Farley slipped or fell into the area around a storm drain and all personnel on scene rushed to help. A Firefighter grabbed hold of Captain Farley while another firefighter held that one. As Lieutenant Zane James went to help the other firefighters pull Captain Farley out, Farley and James were pulled into the storm drain.


Lieutenant James was pushed through the storm drain pipe by the water. He held his breath as long as he could before inhaling water. He was ejected from the pipe into a fence, where he was able to crawl back to the street. A firefighter got him to safety while the other firefighters searched for the two separate outlets of the storm drain for any sign of Captain Farley.


James was stable as of Tuesday evening but was being watched for complications "due to his horrific experience," Douglas said.

 

MEMORIAL DETAILS:

A memorial service for Farley will take place at the Claremore Expo Center on Saturday. Doors will open at 10 a.m. and Firefighters will participate in a procession to the Expo Center at 1 p.m.
