What Happens If You Don't Have a Written Paid Sick Leave Policy?
|
Article courtesy of CalChamber
Beginning July 1, 2015, California employers will be required to begin providing paid sick leave benefits to their eligible employees.
We often hear the question: Do I need a written paid sick leave policy that I hand out to employees? With all the complexities of this new law, the answer is "yes."
A written policy allows you to specifically describe and clearly communicate your company's approach to providing the mandatory benefit. A written policy is also required if you place any limits on paid sick leave that are allowed within the law, such as a cap on accrual.
The Labor Commissioner has specifically stated that if an employer provides any additional terms such as caps on maximum use or accruals above the minimum, they must inform employees of those additional terms.

Law Office of William J. Idleman
I started my own law firm to help small businesses with their legal needs. My goal is to maximize your bottom line by limiting legal risk. I remove the legalese out of complex issues and dispense common sense advice based on the applicable legal issues.
Prior to owning my law firm, I spent seven years as a business and real estate litigation attorney. I represented major financial institutions, including banks and mortgage lenders, in all stages of litigation. I defended national mortgage lenders and loan servicers against borrower complaints involving lender liability, wrongful foreclosure, title claims, and violations of state and federal statutes.
I am a graduate of Chapman University School of Law and Dickinson College. Prior to law school, I worked as a registered investment advisor for a TD Ameritrade. As a member of the State Bar of California and the South Carolina Bar, I am admitted to practice in California and South Carolina.
