A.M. Best recently interviewed me as a featured expert for their Insurance Law Podcast Series, a series that "examines timely and important legal issues affecting the insurance industry from an attorney's point of view."
Although not an attorney myself, my firm provides expert structured settlement services to the legal and claims communities so this podcast was a natural fit.
Because of the importance of this topic and its potential impact on settlement negotiations, attorneys everywhere should be apprised of some recent tax law changes in the Golden State and at the Federal level.
California's Proposition 30 and the American Taxpayer Relief Act of 2012 (ATRA) combine to give a new sense of urgency to tax considerations when settling injury claims, particularly on higher dollar cases in high tax states.
This topic was also recently explored in an article I wrote entitled "Taxable Damage Structured Settlements" for the May, 2013 issue of Advocate, a publication of the Consumer Attorneys Association of Los Angeles (CAALA).
